The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 9, 2020, and duly recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Deed of Trust Book 2315, at Page 1, Jessica Leigh Hammel and Joshua Allen Hammel did convey unto Larry F. Mazza and Richard A. Pill, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Jefferson County Courthouse, in Charles Town, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Charles Town District, Jefferson County, West Virginia, and more particularly described as follows:

All of that certain real property, with improvements and appurtenances thereunto belonging, situate, and being, in Charles Town District, Jefferson County, West Virginia, and more particularly described as follows:

Lots Nos. 4 and 5, Section I-J, as the same are designated and described on a plat of the subdivision thereof made for Shannondale, Inc., by W.R. Amos, Surveyor, dated November, 1961, and recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Deed Book 252, at Page 385, to which reference is had.

PROPERTY ADDRESS:  1312 Rolling Lane, Harpers Ferry, West Virginia 25425

SUBJECT TO and TOGETHER WITH the following:  all covenants, restrictions, conditions, easements, reservations, rights-of-way, public utility easements, and other matters of record or in existence, to the extent valid, subsisting, and enforceable; any lien of taxes for the current year and subsequent years, accrued but not yet payable; matters that would be shown by an accurate survey and inspection of the property; zoning requirements, statutes, rules, orders, restrictions, regulations, and ordinances of governmental agencies or their instrumentalities relating to the property, the buildings located thereon, their construction and uses, in force on the date hereof (if any such exist); and, all roads and legal highways.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1312 Rolling Lane, Harpers Ferry, WV 25425.

AND BEING the same real estate which was conveyed to Jessica Leigh Hammel and Joshua Allen Hammel, by Deed dated October 7, 2020, from Todd E. Kelvington and Sandra L. Kelvington, and recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Deed Book 1250, at Page 212.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
