The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 15, 2012, and duly recorded in the Office of the Clerk of the County  Commission of Braxton County, West Virginia, in Document No. 2012002053, in Book No. 223, at Page 753, John W Taylor and Sandra Taylor did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC f/k/a Quicken Loans, LLC f/k/a Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door  of the Braxton County Courthouse in Sutton, West Virginia, on

Those certain lots, tracts and parcels of real estate situate on the waters of O’Briens Fork of Salt Lick Creek, in Salt Lick District, Braxton County, West Virginia, and more particularly bounded and described as follows:

First: Beginning at 5/8″ rebar found on the eastern edge of a 20 foot right-of-way, corner to Lot 7, thence leaving said right-of-way and with Lot 7 (391/254) S 51 degrees 59 minutes 51 seconds E 251.21 feet to a 5/8″ rebar found, corner to Lot 7 and Butler Real Estate 2.23 acre lot (387/269), thence with 2.23 acre lot for two lines S 17 degrees 23 minutes 19 seconds W 97.76 feet to a point, thence S 8 degrees 48 minutes 19 seconds W 155.45 feet to a 5/8″ rebar found corner to 2.23 acre lot and Butler Real Estate (387/269), thence with Butler Real Estate S 83 degrees 40 minutes 19 seconds W 264.16 feet to a point on eastern edge of said 20 foot right-of-way, thence with said right-of-way for four lines N 19 degrees 16 minutes 33 seconds W 110.26 feet to a point, thence N 12 degrees 05 minutes 46 seconds E 132.17 feet to a point, thence N 39 degrees 22 minutes 23 seconds E 125.98 feet to a point, thence N 24 degrees 52 minutes 46 seconds E 110.43 feet to the beginning, containing 2.29 acres, more or less, as surveyed by Brackenrich and Skidmore, Inc., of Sutton, West Virginia, in October, 1982.

Second: Beginning at a 5/8 inch rebar steel rod, (set, bearing a plastic cap labeled Wilkie LLS 717), ten feet east of the centerline of a dirt road, on the eastern edge of a right of way, a corner to Butler Real Estate, Inc.; thence with a line of said Butler and the edge of said right of way; N 04 degrees 57 minutes E 155.46 feet to a point, at the edge of said right of way, a corner to said Butler, thence with Butler and the edge of said right of way N 16 degrees 54 minutes E 97.88 feet to a 5/8 inch rebar steel rod (found), 10 feet east of the centerline of said road, at the edge of said right of way, a corner to said Butler and Arturo B. Sabio, thence with a line of said Sabio and the edge of the right of way, N 23 degrees 15 minutes E 143.93 feet to a 5/8 inch rebar steel rod (found) at the edge of said right of way, a corner to said Sabio, from which a 5/8 inch rebar steel rod (found), a corner to Sabio, is N 20 degrees 07 minutes E 81.14 feet, thence with a line of said Sabio, S. 66 degrees 39 minutes E 194.69 feet to a 14 inch pignut hickory, (found with three hack marks) in a fenceline, a corner to Sabio, from which a dead 20 inch white oak, at an original corner of the tract of which this parcel is a part, where a white oak is called for (27/102, 51/79) is N 00 degrees 33 minutes E 445.1 feet; thence with said fenceline S 02 degrees 28 minutes W 271.42 feet to a point in said fenceline; thence with said fenceline S 02 degrees 23 minutes E 132.96 feet to a 5/8 inch rebar steel rod (set, bearing a plastic cap labeled Wilkie LLS 717), in the fenceline at a corner to Butler Real Estate, Inc., from which a 28 inch black oak at a fence corner, at an original corner of the tract of which this parcel is a part, where a stump is called for (27/102) is S 01 degree 47 minutes E 164.2 feet, a 16 inch hollow sugar maple is N 02 degrees E. 2.8 feet, and a 5 inch hickory is S 45 degrees E 19.6 feet, thence with a line of said Butler, N 69 degrees 42 minutes W 289.26 feet to the beginning, containing 2.233 acres, more or less, as surveyed in August, 1982, by Wilkie Surveying, Inc.

Third: Beginning at a fence post corner of Earnest Williams tract; thence along Williams tract in a northeasterly direction to a stake corner of Williams, Workman and Black; thence along Black line in an easterly direction to a stake; thence along Black line in a northeasterly direction to a 12″ hickory and fence at corner to said Black tract; thence south to a 44″ R. O. and fence post; thence south east approximately 625 feet to a fence post at fence corner and at end of bar gate; thence south west approximately 430 feet to a stake; thence west to a 30″ hickory; thence north west approximately 362 feet to a stake; thence west approximately 487 feet to the place of beginning, containing 15.97 acres, more or less

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  1904 Gauley Tpke, Flatwoods, WV 26621.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

 

The subject property will be sold in “AS IS” condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS:  $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

 

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

 

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
