NOTICE OF TRUSTEE'S SALE Pursuant to the authority vested in the undersigned Campbell Woods, PLLC, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Kanawha, West Virginia, and by Deed of Trust dated June 11, 2009, executed by Mary S. Jividen to BB&T Collateral Service Corporation, Trustee, which deed of trust is of record in the Office of the Clerk of Kanawha County, West Virginia, in Trust Deed Book 3658 at Page 27, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Conner, C.E. September 11, 1929, and being designated as Lot Number 1419 West Fourteenth Street on a map entitled, "West 14th Street area "A" lot layout Nitro Industrial Corporation, Nitro, Kanawha County West Virginia scale 1 inch = 50 feet November, 1952 Section Number 3 part of Plat 2 Nitro Reservation", made by C.R. Conner, C.E., and which map is of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 16 at Page 93, said lot herein conveyed being more particularly bounded and described as follows: Beginning at an iron pipe on the north line of 14th Street, west, common corner between Lots numbers 1417 west and 1419 west; thence with said street line south 81 degrees 05 minutes west 50 feet to an iron pipe, common corner between Lots numbers 1419 west and 1421 west; thence with one line of Lot number 1421 west, north 8 degrees 55 minutes west 117 feet to an iron pipe; thence north 81 degrees 5 minutes east 50 feet to an iron pipe, common corner between Lot numbers 1417 west and 1419 west; thence with one line of Lot number 1417 west, south 8 degrees 55 minutes east 117 feet to the place of beginning, containing 0.13 acre. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in "AS IS" condition.
