TO WHOM IT MAY CONCERN:
The purpose of this action is to partition real property situate in Town District being two parcels of Lot 37 of Garden Farms Addition in Raleigh County, of record in the Office of the Clerk of the County Commission of Raleigh County in Deed Book 5007, at page 1558 in which Mary L. Williams owned an undivided 100% interest in at the time of her death. Mary L. Williams died intestate on February 5, 2020. Upon information and belief, Stephanie Via, Melissa Bennett Recd, Charles Weidensall, and Michael Williams are the sole heirs at law of Mary L. Williams. Plaintiff acquired the interest of Melissa Bennett Recd and Charles Weidensall. The whereabouts of Michael Williams are unknown and the last known address for Stephanie Via is Pinc Lodge Drive, Beckley, WV. Plaintiff is seeking to partition the real property in which Mary L. Williams owned a l00% undivided interest at the time of her death.
It appearing that the whereabouts of Michael Williams or any known or unknown heirs of Mmy L. Williams is presently unknown at this time, it is ORDERED that Michael Williams and Stephanie Via or any known or unknown heirs of Mary L. Williams or anyone claiming interest in the estate of Mary L. Williams and/or the interest in the real property located in Town District being two parcels of Lot 37 of Garden Farms Addition in Raleigh County, of record in the Office of the Clerk of the County Commission of Raleigh County in Deed Book 5007, at page 1558 do appear and serve upon Robert P. Dunlap, II, Plaintiff's attorney, whose address is 345 Main Street, Beckley, West Virginia, 25801 an answer or other defense to the civil complaint filed in this action before October 10, 2025 otherwise, judgment by default will be taken against him/her at any time thereafter.
A copy of said petition can be obtained from the undersigned Clerk at his office located at 222 Main Street, Beckley, WV 25801.
