NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 19, 2019, executed by Borrower(s), Amanda Estep-Burton, to Andrew C. Skinner, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4373, at Page 873. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1534 Summit Dr, Charleston, WV 25302. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 26, 2025, of record in the Clerk's Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 7th day of November, 2025 at 11:10 a.m. All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, the property located in the City of Charleston. Kanawha County, West Virginia being all of Lot No. 39, Section B, Edgewood Hills, physical address 1534 Summit Drive, Charleston, West Virginia 25302. The property herein conveyed being more particularly bounded and described as follows: Beginning at an iron pipe in the easterly line of East Summit Drive at the front of the common corner of Lots No. 38 and 39 of said Section B, Edgewood Hills, said Lot No. 38 having been conveyed by Property Development Co., Inc. unto Edward Vale Henson and Lois Brown Henson, his wife. by deed dated June 23, 1955, now duly recorded in the Office of the Clerk of the County Court of Kanawha County, West Virginia, said beginning corner being corner located N. 4 deg. E. 239.40 feet, thence N. 11 deg. 34' E. 303.44 feet from the northwesterly corner of Lot No. 33 of Edgewood Hills, as shown upon that certain map entitled "Edgewood Hills Charleston Kanawha County W.Va. a Subdivision of Part of the Second Revisions of Fairview," made by Gardiner S. Plumley, Registered Professional Engineer, under date of April 24, 1959, said last mentioned map being now recorded in the aforesaid Clerk 's Office in Map Book No. 14, at page 108, said Lot No. 33, as shown upon said last mentioned map, having been conveyed by Property Development Co. unto Ellsworth R. Johnson and Ethel Lee Johnson, his wife, by deed dated October 15, 1951, duly recorded in said Clerk' s Office; thence from said beginning corner of the property herein conveyed and running with the easterly line of East Summit Drive, N. 11 deg. 34'E. 15 . 07 feet to an iron pipe and thence N. 28 deg. E. 85 feet to an iron pipe at the front common corner of said Lots Nos. 39 and 40, Section B, Edgewood Hills; thence leaving East Summit Drive and running with the division line between said two last mentioned lots, S. 62 deg. E. 305.48 feet to the rear common corner of said lots in a line of a strip of land adjoining the land of the estate of B.B. Brown. deceased; thence running with said strip of land, S. 35 deg. 51' E. 85.30 feet to an iron pipe in the rear line of said Lot No. 3; thence with the rear line of said Lots Nos. 38 and 39; thence with the dividing line between said Lots N. 62 deg. W. 377.79 feet to the place of beginning. This deed is made upon the express condition that the property herein conveyed shall be used for residential purposes only; that only one building in addition to a garage or servants' quarters shall be erected upon said property herein described; that the improvements erected upon said property shall cost at least Fourteen Thousand Dollars ($14,000); and that any such improvements shall be so constructed and so created with reference to the line of East Summit Drive as to comply with the zoning ordinance of the City of Charleston. It is understood that a sewer line now extends across said Lot No. 39 herein conveyed and that another sewer line extends along a part of the southerly side line of said lot, from Summit Drive to the first sewer line hereinabove mentioned. both of which sewer lines are to be used and maintained for the mutual benefit of the owner of the property herein conveyed and the owners of all other lots in said Edgewod Hills whose properties may be so situate or located as to be benefited by the use of said sewers; and the Grantor hereby grants the Grantee the right to use said sewers, but subject, however, to the rights of such owners of such other lots in Edgewood Hills to enter in and upon the property herein conveyed for the purpose of repairing and maintaining said sewers; provided, that in making any such repairs or in maintaining such sewers, those responsible for having the work done shall, at their expense and in good workmanlike manner, properly fill all excavations made in and upon the premises aforesaid and restore thereon the surface, sod, shrubbery, walkways and other improvements that may have been damaged in making any such repairs to said sewers or in maintaining the same. And being the same property conveyed unto Jane N. Knight by Jane N. Knight, Executor of the Last Will and Testament of Janet S. Nunley. deceased, by deed dated July 22, 2016, and recorded in the aforesaid Clerk's Office in Book 2946, at page 621. The said Jane N. Knight died testate on March 7, 2019, in Kanawha County, West Virginia and devised the subject property to the Jane N. Knight Living Trust by her Last Will and Testament dated August 6, 2015, and recorded in the aforesaid Clerk's office in Will Book 940, at Page 753 TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
