NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 26, 2013, executed by the Borrowers, Kristopher C. Otto and Holly J. Otto, to Jeffrey E. Bode, the Trustee, of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Book 917 at Page 257. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 17048 Fish Creek Rd., Cameron, WV 26033. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 15, 2025 of record in the aforesaid Clerk’s Office. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Marshall County, in Moundsville, West Virginia, on the following date:
November 13, 2025, at 12:02 p.m.
All The following described property having tax map number 17, parcel 1.6 and having an address of R. D. #5, Box 117, Cameron located in Liberty District, Marshall County, West Virginia.
A parcel of land situate in Liberty District, Marshall County, West Virginia, along West Virginia Route No. 74, bounded and described as follows:
Beginning at a point located on the west side of said road in the line of Donna K. Kirby`s 2.453 acre tract and located South 16 deg 42` East 157.63 feet from the northwest corner of said Kirby tract; thence running with lands remaining to Glen Stern the following three (3) courses and distances: North 78 deg 16` 21″ East 149.29 feet set a 1 inch iron pipe passing through a 1 inch iron pipe set at 31.96 feet; South 31 deg 11` 39″ East 37.88 feet set a 1 inch iron pipe located on the south side of a utility pole; South 03 deg 45` 25″ East 137.19 feet set a 1 inch iron pipe at the northeast corner of Parcel “A,” as designated on a plat attached to Deed Book 606, page 609; thence running with the north side of Parcel “A”, South 78 deg 17` 28″ West 127.96 feet to a point located on the east line of said Kirby tract, passing through a 1 inch iron pipe at 93.48 feet; thence running with the east side of said Kirby tract, North 16 deg 42` 00″ West 172.19 feet to the place of beginning, containing 0.573 acres, more of (sic) less, as surveyed by Charles V. Eller, April 29, 1980, and being Parcel “B” as shown on said plat attached to Deed Book 606, page 609.
The above-described property is commonly known as: 17048 Fish Creek Road, Cameron, WV 26033
Being the same property conveyed to Kristopher C. Otto and Holly J. Otto by the Deed dated April 26, 2013 and recorded in Deed Book 794 at Page 627 in the Office of the Clerk of the County Commission of Marshall County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
