Each Bid shall be accompanied by a Bid Bond for 5% of the amount of the Bid; or a Certified Check, Cashier’s Check, or Letter of Credit in an amount not less than ten percent of the Total Bid as a Guaranty that if the Bid is accepted, a Contract will be entered into and its performance properly secured. Should any Bid be rejected, such Bid Guaranty will be forthwith returned to the Bidder, and shall any Bid be accepted, such Bid Guaranty will be returned upon the proper execution and securing of the contract. No Bidder may withdraw his Bid within 90 days after the actual date of the opening thereof. The Taylor County Commissioners reserve the right to reject any or all Bids, to waive any informalities in the Bids received, and to accept any Bid or combination of Bids which is deemed most favorable to the County at the time and under the conditions stipulated. The Commissioners further declare that they will award the contract for this Project to the lowest and best Bid, which may not necessarily be the lowest Bid. No single factor will control the Commissioner’s decision to award, and the Commissioners reserves the right to exercise its full discretion.
