NOTICE OF SUCCESSOR TRUSTEE’S SALE

Notice is hereby given that default having occurred in the payment of that certain indebtedness secured by a deed of trust dated January 26th, 2022, between Lawrence E. Sherman, Jr. and William C. Keaton and/or W. Joseph Milleson, Jr., Trustees, recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book No.683, at page 200; which deed of trust authorizes the beneficial owner to remove and appoint a Successor Trustee to act in person, or by agent, at its option, and the beneficial owner exercised such option and appointed Nelson M. Michael as its Successor Trustee to act in the enforcement of said deed of trust in person, or by agent, and the undersigned Successor Trustee having been requested in writing by the beneficial owner of said indebtedness to enforce said deed of trust, will sell at public auction to the highest bidder the following hereinafter described real estate on

All that certain tract or parcel of real estate more particularly described as follows:

All that certain lot or parcel of real estate, known and designated as Tract B-2 on the Southeast side of Us Route 220, situate in Mill Creek District, Hampshire County, West Virginia, containing 111.8472 acres, more or less, together with any and all roads, rights-of-way, easements, improvements, and appurtenances, being more particularly shown on that Plat and Survey as prepared by Edward J. Mayhew, Professional Surveyor, dated September 22, 1998, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Map Book 9, at Page 12, and also by that Description of Survey as prepared by Edward J. Mayhew, Professional Surveyor, a copy of the same of record in the aforesaid Clerk’s Office in Deed Book 387 at Pages 778-781, reference being hereby made to said map and plat, as well as Description of Survey for a more particular metes and bounds description of said real estate.

LESS, HOWEVER, that certain out conveyance of 95.59 acres, more or less, which was conveyed by DBB WVA, LLC, a Virginia Limited Liability Company, by deed dated December 7, 2016, and which said deed is of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 539, at page 688. Said Deed is by reference made a part hereof for a more particular description of said out conveyance and for all pertinent and proper reasons.

THUS LEAVING for purposes of this conveyance, approximately 16.2572 acres, more or less, although this is a conveyance IN GROSS and not by the acre.

Said real estate is depicted on the Hampshire County Land Books as Tax Map 15, Parcel 12.2 for Mill Creek District.

And being a portion of the same real estate which was conveyed unto Lawrence E. Sherman, jr., and K. Hayes Sherman, his wife, by deed of Renick C.Williams and Betty P. Williams, his wife, dated October 16, 1998, of record in the aforesaid Clerk’s Office in Deed Book No. 187, at page 773. Further being the same real estate in which K. Hayes Sherman conveyed all of her right, title, and interest in said real estate unto Lawrence E. Sherman, Jr., by deed dated December 22, 2010, and of record in the aforesaid Clerk’s Office in Deed Book No. 498, at Page 163.

This property is improved by a 3,636 square foot two story home with a basement, 10 rooms, including 4 bedrooms, and 3 and 1/2 bathrooms, and an attached 3 car garage.

The physical address of this property is 268 Mill Creek Outpost Trail, Purgitsville, West Virginia 26852.

This sale is specifically made subject to the following additional outstanding deeds of trust in favor of The Bank of Romney:

1. Deed of Trust dated July 28th, 2021 from Lawrence E. Sherman, Jr. to William C. Keaton and Jospeh Milleson, Jr., Trustees to secure The Bank of Romney, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed of Trust Book 673 page 460.

2. Deed of Trust dated February 7th, 2020, from Lawrence E. Sherman, Jr. to William C. Keaton and Jospeh Milleson, Jr., Trustees to secure The Bank of Romney, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed of Trust Book 644 page 613.

3. Deed of Trust dated December 23rd, 2016 from Lawrence E. Sherman, Jr. to William C. Keaton and Jospeh Milleson, Jr., Trustees to secure The Bank of Romney, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed of Trust Book 605 page 283.

The above described real estate will be conveyed by the undersigned Successor Trustee by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service district/municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk’s office and affecting the subject real estate and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the day of sale.

The property will be sold in its present condition “AS IS”. The undersigned Successor Trustee makes no warranties as to the condition of the premises.  Said Successor Trustee shall be under no duty to cause any tenant or other persons occupying the premises to vacate same.

All net proceeds of sale shall be first applied to the satisfaction of the aforesaid deed of trust liens.

TERMS OF SALE

1. Ten percent (10%) deposit on day of sale; balance upon delivery of deed;

2. Subject to any prior deeds of trust or security agreements of record;

3. Subject to any special assessments or any liens for taxes;

4. The abovedescribed real estate will be sold by the undersigned Trustee by auction to the highest bidder subject to the right of the undersigned Trustee to reject all bids if, in his opinion, said bids are inadequate;

5. The owner of the indebtedness secured by the abovedescribed deeds of trust shall have the right to bid.

6. Buyer shall be responsible for payment of all recording fees and transfer tax.

7. Real estate taxes will be pro-rated at the time of settlement

CONTINUANCE OR ADJOURNMENT OF SALE

The undersigned Successor Trustee reserves the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
