FOR BIDS
Sealed Bids for the construction of:
Mozart Sanitary Sewer Extension Project
Contract No. 2 – Furnishing all materials, labor, and necessary items for the construction and installation of approximately 5,600 LF of 12″ gravity sewer line; 1,820 LF of 6″ PVC sewer lateral line; 35 wastewater manholes; 740 LF of 18″ CMP; 13 Type G inlets; 13 storm manholes and all other items and appurtenances as outlined in the Plans and Specifications.
Sealed Bids for the construction of Contract No. 1 will be received by John L. Blair (Chairman- Marshall County Sewerage District) at the office of the Marshall County Sewerage District at the offices of the Belomar Regional Council, 105 Bridge Street Plaza, Wheeling, WV 26003, until 2:00 p.m. local time on November 12, 2015, at which time the Bids received will be publicly opened and read. A mandatory pre-bid meeting will be conducted at the office of the Belomar Regional Council, 105 Bridge Street Plaza, Wheeling, WV 26003, at 10:00 a.m. on October 28, 2015.
Separate Bids will be received for Contract No. 2 – General Construction. Bids shall be on a lump sum and unit price basis for both contracts as indicated in the Bid Form.

Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above, upon payment of a deposit of $200.00 for each set. Bidders who return full sets of the Bidding Documents in good condition (suitable for re-use) within 30 days after receipt of Bids will receive a full refund. Checks for Bidding Documents shall be payable to “E.L. Robinson Engineering Company”. Upon request and receipt of the document deposit indicated above, the Issuing Office will transmit the Bidding Documents via delivery service. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

A two envelope system will be used.

Envelope No.2 labeled “Bid Proposal” shall also be placed inside of Envelope #1.

Envelope No.1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR – 1 of these contract documents. If such documents are found to be in order, Envelope No.2 ”Bid Proposal”, will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No.1 are not in order, Envelope No.2 “Bid Proposal” will not be opened and the Bid
will be considered non-responsive and will be returned to the Bidder.

Bidders must comply with the Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code Section 21-5A-3, and the West Virginia Jobs Act (West Virginia Code Section 21-1C-1).

Bidders must comply with the Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code Section 21-5A-3, and the West Virginia Jobs Act (West Virginia Code Section 21-1C-1).

All Bidders must hold a current WV Contractor License on the date of Bid opening. Any Contractor submitting a bid on this project hereby certifies, indicates, and acknowledges that he/she has a license and meets all the qualifications required by the statues of the State of West Virginia, and subdivision in which the work is to be performed. Note that the bid hold time is 90 days.

Bidders on this work will be required to comply with the President’s Executive Order No. 11246 entitled “Equal Employment Opportunity” as amended by Executive Order No. 11375 and “HUD Section 109,” which prohibits discrimination in employment regarding race, creed, color, sex or national origin.

DBE REQUIREMENTS
Each bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.

The bidder agrees to make “good faith efforts” to sub-contract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.

“Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.”

Recipient shall not entertain the use of businesses that are listed on the “Excluded Parties List System” at:

Contractor is required to provide the Drug Free Workplace Certification in accordance with WV Code 21-lD-5.

Bids shall be accompanied by a certified check or Bid Bond payable to the Marshall County Sewerage District, for an amount equal to five percent (5{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the base Bid.
