ORDER OF PUBLICATION
The object of this suit is to seek a declaratory judgement
from the Court concerning the ownership of certain oil
and gas situated in Wetzel County, West Virginia.
TO THE ABOVE NAMED DEFENDANTS:
It appearing by Affidavit filed in this action that on May
5, 2025, the Plaintiff filed the above- entitled cause; and
that the Plaintiff has used due diligence to serve copies
of the Summons and Complaint on David Lowther,
Charles Musgrave, Ila Musgrave, Shane Bianchini, and
Austin Bianchini without effect; that the unknown heirs,
successors, or assigns of Clarice Morris, Genelda
Lowther, Charley D. Morris, Aletha DiRemigio, Marcus
G. Morris, Robert A. Lowther, Alice M. Tallman, Gloria
Lowther, Wilma Loretta Morris, Charles E. Morris,
Amanda Morris, Freda Gotscel, Alma Molesky, John
Molesky, Nila Viltro, Albert John Viltro, Susan Kay Viltro,
Vivian Orwick, Carole Pearce, Kaye J. Vahalik, Myrl
Taylor, Harold Delaney, Edith I. Delaney, Norman L.
Delaney, Bobby E. Delaney, Billy E. Delaney, Solomon
C. Miller, and Mary L. Davis; and it is hereby ORDERED
that the Defendants serve upon the Plaintiff’s attorney,
Christian E. Turak, GOLD, KHOUREY & TURAK, L.C.,
510 Tomlinson Avenue, Moundsville, WV 26041, an
Answer including any related counterclaim or defense
you may have to the complaint filed in this action on or
before thirty (30) days after first publication hereof. If
you fail to do so, thereafter judgment, upon proper
hearing and trial, may be taken against you for relief
demanded in the Complaint.
A copy of the said Complaint can be obtained from the
undersigned Clerk at this office. It is further ORDERED
that this Order be published once a week for three (3)
successive weeks in a newspaper of general circulation
in Wetzel County, West Virginia.
