NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated January 20, 2004, executed by Borrower(s), Devon S Wilson and Pamela S Wilson, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Marion County, West Virginia, in Book 793, at Page 587. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 21 Sugarmaple Lane, Fairmont, WV 26554. The borrower(s) defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:

December 9, 2025, at 4:34 p.m.

All of the following described lots or parcels of real estate, situate in Union District, Marion County, West Virginia, in what was formerly known as Section Four (4) of the Monongahela Industrial Company Addition to the City of Fairmont, a map or plat of which said Section Four (4) is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 262, page 570, the same having been replatted and a map thereof recorded in said Clerk's Office in Deed Book 262, page 571, all of said lots hereinafter described being located in Section C of the Fairmont Heights Addition to the City of Fairmont, as shown on said map or plat of record in said Clerk's Office in Deed Book 262, page 571, and being more particularly described as follow:

First Parcel: Lot Number One (1) in Section C of Fairmont Heights Addition, said Lot being 60 feet wide and 120 feet long.

Second Parcel: Lot Number Two (2) in Section C of Fairmont Heights Addition, said Lot being 60 feet wide and 120 feet long.

Third Parcel: Lot Number Three (3) in Section C of Fairmont Heights Addition. Beginning at a point in the northerly line of Carpenter Street, S. 43 degrees 38 minutes E. 41.4 feet to corner of Carpenter Street and Maple Drive; Thence with the westerly line of Maple Drive, N. 78 degrees 33 minutes E. 60.7 feet to corner of Lot No. 4; Then with same, 694.4 feet to corner of Lot No. 2; and with same, 120 feet to the place of beginning.

Fourth Parcel: Lot Number Four (4) in Section C of Fairmont Heights Addition. Beginning at a point in the westerly line of Maple Drive and being the northeast corner of Lot No. 3, also the southeastern corner of Lot No. 4, and running thence N. 41 degrees 54 minutes E. 16 feet to a point in said line of Maple Drive; Thence N. 1 degree 45 minutes E. 97.1 feet to point in said line of Maple Drive and common corner to Lots Nos. 4 and 5; Then proceeding in a southwesterly direction with the division line of Lots 4 and 5, a distance of 85.1 feet to appoint in common corner to Lots Nos. 5, 4, 3, and 2; and Thence proceeding in a southeasterly direction with the division line of 4 and 3, a distance of 69.34 feet to the place of beginning.

Fifth Parcel: Lot Number Five (5) in Section C Fairmont Heights Addition. Beginning at a point in the Western line of Maple Drive and common corner to Lots Nos. 4 and 5; Thence in 1 degree 45 minutes E. 48.5 feet to a point in said line; Thence N. 43 degrees 38 minutes W. 26 feet to a point in said Western line of Maple Drive and common corner to Lots Nos. 5 and 6; Thence proceeding in a southwesterly direction with a division line of Lots No. 6 and 5, a distance of 120 feet to a point and common corner to Lots Nos. 6, 5, 2, and 1; Thence proceeding with the division line of Lots Nos. 5 and 2 in a southeasterly direction, a distance of 60 feet to a point, being common corner to Lots Nos. 5, 4, 3, and 2; Thence proceeding in a northeasterly direction with the division line of Lots Nos. 5 and 4, distance of 85.1 feet to the place of beginning.

Sixth Place: Lot Number Six (6) in Section C of Fairmont Heights Addition, Said Lot fronting 60 feet on Princeton Street and extending back in a westerly direction between parallel lines along Forest Street, a distance of 120 feet to the rear of Lot No. 1.

Seventh Parcel: Part of Lots Numbers Four (4), Five (5), Six (6), and Seven (7) in Block D of Fairmont Heights, beginning at an iron pin in the intersection of Carpenter Street and Forest Street, and running thence with the northern line of Carpenter Street, N. 43 degrees 38 feet W. 210 feet to an iron pin, corner to Lot No. 3; Thence with Lot No. 3, N. 46 degrees 22 feet E. 107 feet to a tree; Thence with an arbitrary line running through Lots Nos. 4, 5, 6, and 7, S. 43 degrees 38 feet E. 210 feet to an iron pin in the edge of Forest Street; and thence with Forest Street, S. 46 degrees 22 feet W. 107 feet to the place of beginning. A map or plat of the real estate hereby conveyed is of record in Deed Book 854, Page 470.

Being the same real estate conveyed unto Devon S. Wilson, by deed dated January 9, 2004, and recorded on January 20, 2004, in Deed Book 990, page 308. In the Clerk's Office for Marion County, West Virginia. Less and except the land listed in partial release recorded on April 19, 2004, in Book 221, at Page 66.

This conveyance is made subject to any and all exceptions, reservations, restrictions, covenants, agreements, easements, rights of way, limitations, and conditions as contained in prior deeds of conveyance in this chain of title and other instruments which are of record in the aforesaid Clerk's Office.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
