ORDER OF PUBLICATION
The object of the above-referenced civil action is to quiet title to certain real property located in Jefferson County, West Virginia.
It appearing by a certain returned Summons/Affidavit Of Non-Service, which was filed in this civil action on November 14, 2025, that, after due diligence, the whereabouts of respondent Montey Jay Nickens-Allen are unknown and respondent Montey Jay Nickens-Allen cannot be located. Accordingly, pursuant to Rule 4(e)(1) of the West Virginia Rules of Civil Procedure, it is hereby ORDERED that respondent Montey Jay Nickens-Allen shall, on or before December 29, 2025, serve upon petitioner NewRez LLC, d/b/a Shellpoint Mortgage Servicing’s attorney, R. Terrance Rodgers, of the law firm of Kay Casto & Chaney PLLC, whose address is P.O. Box 2031, Charleston, West Virginia 25327, an answer or other defense to the Petition For Declaratory Relief Regarding Certain Real Property filed in this civil action, otherwise default may be taken against respondent Montey Jay Nickens-Allen at any time thereafter.
