NOTICE OF REQUEST FOR RIGHT-OF-WAY AGENT SERVICES PROPOSAL The Mingo County Public Service District, located in Mingo County, West Virginia, is requesting proposals from right-of-way agents for its Gilbert Hanover Waterline Extension Project. Procurement of said services shall be in accordance with 2CFR200, specifically 200.459. Contracts are to be awarded on a per property rate with a ceiling amount. All right-of-way agents interested in being considered for this project must submit a proposal detailing qualifications, technical expertise, and related prior experience. The objective of the competitive process is to objectively select a right-of-way agent who will provide the highest quality of service at a realistic fee. Accordingly, technical qualifications and experience will be weighed heavily. The selected firm will be required to comply with all regulations including, but not limited to Title VI of the Civil Rights Act of 1964, Executive Order 11246 and the provisions of Executive Order No. 10925 as included therein, Section 109 of the Housing and Urban Development Act of 1974, Conflict of Interest Statement of Access to Records provision. The proposed work to be performed may be subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall to the greatest extend feasible, be directed to low-and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The project sponsor will afford full opportunity for disadvantaged business enterprises to submit a show if interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, creed, color, sex, age, handicap or national origin in the contract award. This contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project sponsor, price and other factors considered.
