NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated April 9, 2021, executed by the Borrower(s), Jeffrey F. Gergely aka Jeffrey Gergely and Reney L. Gergely aka Reney Gergely, to Richard A. Pill, the Trustee, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 666, at Page 645. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 142 Miracle Drive, Springfield, WV 26763. The Borrower(s) defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on the following date:
January 6, 2026, at 2:32 p.m.
All that certain tract or parcel of real estate located north of Springfield, West Virginia, east of and adjacent to West Virginia Route 3, situate in Springfield District, Hampshire County, West Virginia, together with any and all improvements, easements, and appurtenances thereunto belonging, which parcel of real estate was surveyed by Kennis F. Snyder, Licensed Land Surveyor, and according to said survey and plat the parcel of real estate herein conveyed contains 2.81 acres, more or less. Said parcel is more particularly described according to the metes and bounds description of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed Book 327 at Pages 149 and 150. Said tract is further shown on that certain plat of record in the aforesaid Clerk`s Office in Deed Book 327 at Page 153, which said Description and Plat are incorporated herein for all pertinent and proper reasons, including for a more particular description of said real estate. Said real estate is depicted on the Hampshire County Land Books as being Tax Map 7, Parcel 34.5, for said District.
And being the same real estate conveyed unto Reney L. Gergely and Jeffrey F. Gergely, her husband, by deed of Ronald L. Adams and Timberlie J. Adams, dated March 16, 2021, and recorded in Deed Book 574, at Page 32, in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.
TOGETHER WITH AND SUBJECT TO that certain paragraph that appears in that certain deed of conveyance from Ronald L. Adams unto Ronald L. Adams and Timberlie J. Adams, his wife, dated August 17, 2009, of record in the aforesaid Clerk`s Office in Deed Book 485, at page 642: “There is also conveyed to the grantees herein, their heirs and assigns, and said real estate is taken subject to, that certain twenty foot (20’) wide right of way as shown on the above mentioned plat, as a means of ingress and egress to the real estate herein conveyed, which right of way is not exclusive, and may be used by all parties who currently utilize same, or having the right to use the same. Said right of way is known as Miracle Drive.”
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
