TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 24, 2006, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 1645196, in Book No. 1292, at Page 626, James M. Plants did convey unto Richard Pill, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 25, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank National Association, as Trustee for SASCO Mortgage Loan Trust 2006-WF2 to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on
November 13, 2015 at 1:00 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Wheeling District, Ohio County, West Virginia, and more particularly described as follows:
A parcel of land situated in Wheeling, Ohio County, West Virginia, and being more particularly described as the following:
Lot numbered Thirty-Five (35) as shown and designated on the Plat of Hazelwood, which plat is recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 1, Page 148, said lot fronting forty (40) feet on the northerly side of Virginia Avenue as shown on said plat and extending back northwardly of even width one hundred twenty (120) feet to a twelve foot alley in the rear.
The coal underlying the aforesaid lot is excepted and not hereby conveyed.
This conveyance is subject, however, to the fifteen (15) foot building line shown on said plat of record in said County Clerk’s office.
This conveyance is made subject to the exceptions, reservations, covenants, conditions, restrictions and easements, if any, granted by or acquired from the party of the first part and his predecessors in the title to said land.
Being the same property which was heretofore conveyed to James Michael Plants and Theresa A. Plants, his wife, by Doris Headley, widow, Franklin H. Kaufman and Bette H. Kaufman, his wife, by a Deed dated the 1st day of September 1999, and recorded in the aforesaid County Clerk’s office in Deed Book No. 715, at page 288. Thereafter the said Theresa A. Plants, pursuant to a Divorce Settlement Agreement, conveyed all of her right, title and interest in and to the Subject property to James Michael Plants, by a Deed dated the 5th day of July, 2005, and recorded in the aforesaid County Clerk’s office in Deed Book No. 760, at page 529.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 5 East Paxton Avenue, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $4,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
