NOTICE OF
TRUSTEE’S SALE
Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Ohio, West Virginia, and by Deed of Trust dated January 31, 2020, executed by Monarch Development, LLC to John E. Gompers, Trustee, which deed of trust is of record in the Office of the Clerk of Ohio County, West Virginia, in Trust Deed Book 1596 at Page 638, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on January 16, 2026, at 1:00 p.m. to the highest bidder at the front door of the Courthouse of said County of Ohio, in Wheeling, West Virginia, which real estate is more completely described as follows:
The following parcel of land situated on the northerly side of the Wheeling and Elm Grove Road (State Route 91), Village of Bethlehem, Bethlehem District, Ohio County, West Virginia, and comprising parts of Tract “C” and Lots Numbered Sixteen (16) and Seventeen (17), as shown and designated on the “Plat of Bopp Addition” to Bethlehem, Ohio County, West Virginia, recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 379, at page 12, and being more particularly bounded and described as follows:
Beginning at a point in the northerly line of the Wheeling and Elm Grove Road (State Route 91), said point being the most northwesterly corner of the property heretofore conveyed by Thomas J. Roth and Betty L. Roth, his wife, to Harry L. Buch and Patricia A. Gompers, by deed dated the 30th day of March, 1960, and of record in the aforesaid County Clerk’s office in Deed Book No. 417, at page 76; thence from said beginning point and with the most northwesterly line of the aforesaid parcel of the following courses and distances: N. 37 degrees 12′ E. 85.05 feet to a point; thence S. 60 degrees 10′ E. 64.94 feet to a point in the division line between Tract “C” and Lot Numbered Sixteen (16); thence N. 14 degrees 20′ E. 9.55 feet to a point; thence S. 75 degrees 40′ E. 125 feet to a point; thence S. 14 degrees 20′ W. 77 feet to a point in the northerly line of Wheeling and Elm Grove Road (State Route 91 }; thence along said road, N. 75 degrees 40′ W. 185.32 feet to a point in the northerly line of said road; thence with a curve to the right, having a radius of 100 feet for an arc distance of 36.1 feet, the chord bearing and distance for said arc, being N. 65 degrees 19′ 30″ W. 35.9 feet to the place of beginning.
This property is subject to a right of way and easement to be used in common by Grantor and others, and their successors and assigns which is described as follows:
Beginning at a point in the northerly line of the Wheeling and Elm Grove Road (State Route 91), at the southwesterly corner of the parcel of land that was conveyed by Chico Dairy Company, Inc., to The Bank of Wheeling, by deed dated May 17, 1983, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 612, at page 486, of which the herein described easement is a part; thence from said beginning point and following along the westerly line of the aforesaid parcel N. 37 degrees 12′ E. 60 feet to a point; thence leaving said westerly line and crossing through said parcel, the following two (2) bearings and distances: S. 18* 13′ 44″ E. (following along the northerly line of the existing concrete drive) 8 and 15/100 feet to a point at the northwesterly corner of the building now occupied by Jay’s Pharmacy; thence with the westerly wall of same and then the southerly extension thereof S. 22 degrees 04′ 52″ W. 52 and 24/100 feet to a point in the aforesaid northerly line of the Wheeling and Elm Grove Road; thence with same, with a curve to the right having a radius of 100 feet for an arc distance of 21 and 11/100 feet, chord bearing and distance for said arc being N. 61 degrees 02′ W. 21 and 07/100 feet to the place of beginning, containing by survey made by Stegman and Schellhase, Inc., Civil Engineers and Surveyors, 776.36 square feet, more or less.
There is excepted and reserved all coal, coal mining rights and privileges, the same having been heretofore conveyed.
The above conveyance is made subject to all exceptions, reservations, conditions, restrictions and easements contained in prior deeds of conveyance for the above described parcel of real estate.
TERMS OF SALE
1. Cash in hand paid on the day of sale.
2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever.
3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code Section 11-22-2.
4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.
7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.
8. Such other terms as may be announced at the time of Sale.
