TRUSTEES’ SALE OF VALUABLE REAL ESTATE 7402 Six Mile Road, Danville, WV 25053 In a Deed of Trust dated June 8, 2021, and duly recorded in the Office of the Clerk of the County Commission of Boone County, West Virginia, in Deed of Trust Book 393, at page 319 Nicole L Maynor did convey unto Abraham Law, PLLC, Trustee, certain real property. The beneficial holder of that Deed of Trust has elected to appoint Terra Abstract Trustee West Virginia, Inc. as substitute trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office. Default having occurred under the Deed of Trust and the beneficial holder having instructed the undersigned Trustees to foreclose, this real property will be sold at public auction at the front door of the Boone County Courthouse, 200 State Street, Madison, WV 25130 on: February 26, 2026 At 12:30 PM The property for sale as described by the Deed of Trust is as follows: All those certain tracts or parcels of land, situate, lying and being on Six Mile in Washington District, Boone County, West Virginia and being more particularly described as follow: Parcel One: BEGINNING at the center of a 12 ft. x 22 ft. bridge corner 1; thence in a direction of down the Creek, with the meanders of Six Mile Creek, S 61 degrees 02` E, 65.15 feet to corner 2, in the center of the Creek; thence with the meanders of Six Mile Creek, S 34 degrees 20` E, 25.85 feet to corner 3, in the center of the Creek; thence with the meanders of Six Mile Creek, S 43 degrees 25` E, 70.00 feet to corner 4, in the center of the Creek, thence leaving the Creek and toward the mountain, S 38 degrees 04` W, 131.75 feet to corner 5, near the toe of mountain, thence in a direction of up the hollow, N 34 degrees 01` W, 70.98 feet to corner 6, near the toe of mountain; thence in a direction of up the mountain N 38 degrees 28` W, 187.01 feet to corner 7, a 1/4 inch iron pipe protruding 6 feet above ground, on the point ridge, thence down the point ridge N 13 degrees 30` 09″ W, 229.62 feet, near an old fallen fence to corner 8 on the point, then N 6 degrees 55` W, 61.57 feet to a 36″ leaning beech tree corner 9 near toe mountain, thence N 6 degrees 25` E, 38.71 feet to corner 10, a point opposite the 36″ beech tree and in the center of Six Mile Creek, being 20 feet wide, thence with the. center of said Creek, following its meanders, S 83 degrees 35` E, 182.00 feet to the place of Beginning, containing 1.229 acres. Garrett, her husband, by deed dated May 11, 1990, of record in the Office of the Clerk of the County Commission of Boone County, West Virginia in Deed Book 192, at Page 371; and being corner number 4 of said parcel as shown on a plat thereof recorded with said deed; thence down said creek with the center thereof a distance of bout 83 feet 4 inches to a set stake in the center of said creek; thence to the right a straight line a distance of 129 feet to a set stake; thence bearing slightly to the left a straight line going up the hill a distance of about 357 feet to a small tree marked with paint on the ridge on the back line of the grantor at a barbed wire fence; thence to the right along the ridge and along said back line a distance of 200 feet to corner Number 7 (the southernmost corner) of said 1.229 acre parcel; thence to the right and along and with the line of said 1.229 acre parcel to a set stake at corner Number 6 thereof; thence to the right N 34 01 W along and with the line of said 1.229 acre parcel a distance of 70.98 feet to corner Number 5 thereof; thence to the left and along and with the side line of said parcel a distance of about 131 feet to the place of BEGINNING. The purchaser will take the property subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real property. The purchaser will be responsible for paying any transfer stamp, excise taxes, and recording costs associated with recording the Trustee’s Deed into their name. The purchaser will be responsible for paying any unpaid property taxes owed to the Sheriff of Boone County prior to or following the sale directly to the Sheriff. The purchaser will take the property subject to any deed of trust, judgment, lien, and any other encumbrance having priority over the deed of trust referred to herein. The purchaser will take the property subject to any deed of trust, judgment, lien, and any other encumbrance that is junior (“junior claims”) to this Deed of Trust and to which sufficient notice was not given. In that case, unless such right to notice is waived, the chain of title shall not merge with this Deed of Trust as to those unnoticed deeds of trust, judgments, liens, and other encumbrances and will be subject to a further noticed and published sale under this Deed of Trust pursuant to W.Va. Code 38-1-4, in which bidding shall resume at the last highest bid given. In the event of a surplus of such sale, the mortgagors and noticed junior lienholders are hereby on notice that if such surplus is less than Two Thousand Five Hundred Dollars ($2,500.00), then the Substitute Trustee will disburse those proceeds to the most senior interest holder as it sees fit, unless an objection is made in writing. The Trustees do not guarantee or represent that the boundaries described above are accurate, are not encroached upon, or that any particular structure located on the property is contained within the described boundaries. The property is therefore sold subject to an accurate survey at purchaser’s expense. The Trustees reserve the right to adjourn the sale, for a time, or from time to time, by announcement at the time and place of sale described above or any adjournment thereof. Such adjournment will be noticed by posting a notice at the front door of the county courthouse or where such notices are traditionally posted at the county courthouse. Such notice will include the date and time when such sale will reconvene. The Trustees reserve the right to reject any and all bids for any reason. The Trustees make no representations as to the condition of the property. The property will be sold in “AS IS” condition. The Trustees make no representations as to whether the property is occupied. The purchaser is responsible for gaining access and possession of the property. Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The purchaser may assign its rights prior to the delivery of the trustee’s deed by a signed request in writing to the trustee; the assignee of the purchaser shall be bound by all terms and conditions applicable to the purchaser. The Trustees will deliver a trustees’ deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code 38-1-6. The Trustees make no representations and warranties about the title of the real estate to be conveyed. If the Trustees are unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is return of deposit.
