The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 22, 2020, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1611, at Page 404, David J. Orosz did convey unto Seneca Trustee’s Inc., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse, in Wheeling, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Tridelphia District, Ohio County, West Virginia, and more particularly described as follows:
The following tract of land situate on the westerly side of a right of way or roadway, thirty (30) feet wide, west of Chapel Hill Road, Triadelphia District, Ohio County, West Virginia, containing approximately 1 and 588/1000 acres, being also known as Lot Number 9 on the Plat of Heather Hill, Section 1, and being more particularly bounded and described as follows:
Beginning at a point at the northeasterly corner of the herein described tract, in the center line of said right-of-way or roadway, said beginning point being located S. 21 degrees 01′ W. 14 and 69/100 feet from a point at the northwesterly corner of the 1 and 464/1000 acre tract of land that was conveyed by Kermit C. Trenton and Charlotte M. Trenton, his wife, to Robert T. Neidhardt and Kathleen O’Leary, by Deed dated March 28, 1988, and recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 641, at page 198; thence from said beginning point and with said center line S. 21 degrees 01′ W. 200 feet to a point at the northeasterly corner of a 1 and 535/1000 acre tract of land formerly owned by the party of the first part hereto; thence with the northerly line of same N. 68 degrees 59′ W. (passing iron pins at 15 feet, 123 and 67/100 feet and at 225 and 71/100 feet) 346 and 06/100 feet to an iron pin; thence with other lands remaining to the party of the first part hereto, the following two (2) bearings and distances: N. 68 degrees 59′ W. 346 and 06/100 feet to an iron pin; thence with other lands remaining to the party of the first part hereto, the following two (2) bearings and distances: N. 21 degrees 01′ E. 200 feet to an iron pin, thence S. 68 degrees 59′ E. (Passing iron pins at 142 and 02/100 feet, 231 and 42/100 feet, and at 231 and 43/100 feet) 346 and 06/100 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, one and five hundred eighty-eight one thousandths (1 and 588/1000) acres, more or less.
There is also granted to the party of the second part hereto the right to use the aforesaid right of way or roadway thirty (30) feet wide, leading from the southeasterly corner of the above-described 1 and 588/1000 acre tract to the Chapel Hill Road, the center line being more particularly described as follows:
Beginning at a point in the centerline of said right-of-way or roadway thirty (30) feet wide, at the southeasterly corner of the above-described 1 and 588/1000 acre tract; thence from said beginning point and with said center line of the following nine (9) courses and distances: N. 21 degrees 01′ E. 249 and 69/100 feet to a point; thence with a curve to the left having a radius of 467 and 36/100 feet, for an arc distance of 199 and 3/10 feet, the chord bearing and distance for said arc being N. 08 degrees 48′ E. 197 and 8/10 feet to a point; thence N. 03 degrees 25′ W. 161 and 63/100 feet to a point; thence with curve to the right having a radius of 350 feet, for an arc distance of 95 and 6/10 feet, the chord bearing and distance for said arc being N. 04 degrees 24′ 30″ E. 95 and 3/10 feet to a point; thence N. 12 degrees 14′ E. 261 and 14/100 feet to a point; thence with a curve to the right having a radius of 475 feet, for an arc distance of 244 and 5/10 feet, the chord bearing and distance for said arc being N. 26 degrees 58’45” E. 241 and 81/100 feet to a point; thence N. 41 degrees 43′ 30″ E. 67 and 49/100 feet to a point; thence with a curve to the right having a radius of 31 and 4/10 feet, for an arc distance of 24 and 74/100 feet, the chord bearing and distance for said arc being N. 64 degrees 17′ 25″ E. 24 and 1/10 feet to a point; thence N. 86 degrees 51′ 20″ W. 28 feet to a point in Chapel Hill Road, said right-of-way or roadway, thirty (30) feet wide, to be used in common by both parties hereto, their heirs and assigns.
The said 1 and 588/1000 acre tract being subject to that part of the right-of-way or roadway that is included within the boundary lines of said 1 and 588/1000 acre tract.
The said 1 and 588/1000 acre tract of land being subject to any and all conditions, exceptions, reservations, stipulations, rights-of-way, etc., as may be contained in former deeds of conveyance.
This conveyance is also subject to the following covenants and restrictions recorded in Deed of Trust Book 1611, at Page 408 and 409.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 124 Hollie Drive, Tridelphia, WV 26059.
AND BEING the same real estate which was conveyed to David J. Orosz, by Deed dated September 2, 2020, from Todd Fullerton, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 988, at Page 625.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
