Donahue, Jr. Maxine Abundis, Unknown Heirs, Devisees, Assigns and Creditors Address and Whereabouts Unknown The purpose of the above-styled action, pursuant to the Complaint for Partition filed herein, is to obtain an order to allot the Defendants’ interest in that certain 3.79 acre tract of real estate, situate in Glade District, Webster County, West Virginia, as described in deed dated March 21, 1988, of record in the office of the Clerk of the County Commission of Webster County, West Virginia, in Deed Book 211, page 362. Defendants Paul Donahue, Jeffrey Donahue, Preston L. Donahue, Jr., and Maxine Abundis, are believed to be heirs at law of Preston L. Donahue, Deceased, whose current whereabouts are unknown to Plaintiffs. The Estate of Preston L. Donahue, is unopened, un-administered and unsettled. It appearing to the Court that Plaintiffs have used due diligence to locate Defendants the Estate of Preston L. Donahue, Deceased, Paul Donahue, Jeffrey Donahue, Preston L. Donahue, Jr., and Maxine Abundis, or their unknown heirs, devisees, assigns and creditors with a copy of the Summons and Complaint in this action, with the whereabouts of said Defendants being unknown, that a general publication is necessary to notify said Defendants of the pendency of this action, with the whereabouts of said Defendants being unknown to the Plaintiffs herein. It is ORDERED that any Defendants the Estate of Preston L. Donahue, Deceased, Paul Donahue, Jeffrey Donahue, Preston L. Donahue, Jr., and Maxine Abundis, and their unknown heirs, devisees, assigns and creditors, appear and serve upon W. T. Weber, III, Weber & Weber, PLLC, Plaintiffs’ attorney, whose address is 239 Main Avenue, P.O. Box 270, Weston, West Virginia 26452, an answer or other defense to the Complaint for Partition as filed in this action on or before the 28th day of February, 2026, otherwise judgment by default may be taken against said Defendants, jointly or severally, at any time thereafter.
