UPSHUR COUNTY RECREATION PARK TENNIS COURT RESURFACING UPSHUR COUNTY, WV ADVERTISEMENT FOR BIDS Sealed Bids for the construction of the TENNIS COURT RESURFACING project will be received by the UPSHUR COUNTY COMMISSION until 4 p.m. local prevailing time on Wednesday, February 18, 2026, at the Upshur County Administrative Annex, 91 W Main Street, Suite 101, Buckhannon, WV 26201. Bids will be “publicly” opened and read aloud at 9:30 a.m. local prevailing time on Thursday, February 19, 2026, at the Upshur County Court House Annex, Room 301, 38 West Main Street, Buckhannon, WV 26201. The project consists of resurfacing the existing recreation park tennis courts to establish a new court surface for tennis and pickleball, as well as asphalt ADA parking and drainage improvements. In addition to the removal of the existing fencing, court net posts, and asphalt surface, approximate proposed construction quantities include 425 tons of asphalt paving, 75 tons of stone base, 80 linear feet of 6″-12″ storm pipe, 1,060 linear feet of 10′ high galvanized chain link fence, respreading asphalt millings, court coating and striping, tennis nets and portable pickleball net, light fixtures, erosion and sedimentation controls and permanent seeding, and other miscellaneous items. Funding for this project is provided in part by a grant from the Land and Water Conservation Fund, administered through the West Virginia Department of Commerce. Printing copies can be requested, and the cost of printed Bidding Documents will depend on the number and size of the Drawings and Project Manual, applicable taxes, and shipping method selected by the prospective Bidder. Cost of Bidding Documents and shipping is non-refundable. Upon receipt of payment, printed Bidding Documents will be sent via the prospective Bidder’s delivery method of choice; the shipping charge will depend on the shipping method chosen. The date that the Bidding Documents are transmitted by the issuing office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of the Bidding Documents will not be available from the issuing office. A mandatory pre-bid conference will be held at 1 p.m. local time on February 4, 2026, onsite at 308 B-U Drive, Buckhannon, WV, 26201. All questions must be submitted to CEC in writing by 4 p.m. Local Prevailing Time on February 10, 2026. A two-envelope system will be used and will be described in more detail at the mandatory pre-bid conference referenced above. All Bidders are required to have a West Virginia Contractor’s License as per Section 30-42-12 of the West Virginia Code. The license classification shall be appropriate for the work for which the bid is prepared. The bidder’s license number shall be included in the first envelope as part of the Bid Opening Requirements. All subcontractor(s) shall furnish their contractors’ license number(s) to the prime contractor prior to the award of the contract. Bid security shall be furnished in accordance with the Instructions to Bidders. Bidders on this work will be required to comply with the Build America, Buy America Act (“the Act”), Pub. L. No. 117-58, 70901-52 signed into law on November 15, 2021, by President Joseph R. Biden Jr. Each Bidder must fully comply with the Disadvantage Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantage Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract. The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out this requirement is a material breach of this contract which may result in the termination of this contract or other legally available remedies. Bidders on this work will be required to comply with the President’s Executive Order No. 11246 entitled “Equal Employment Opportunity” as amended by Executive Order No. 11375 which prohibits discrimination in employment regarding race, creed, color, sex or national origin. No Bidder may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids. Any Contractor submitting a Bid on this project hereby certifies, indicates, and acknowledges that he has a license and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed. The Contractor shall comply with the West Virginia Contractor Licensing Act and shall require all subcontractors to comply with that Act. A contractor’s License Number is to be included in the bid submission.
