ADVERTISEMENT FOR BIDS TOWN OF COWEN WEBSTER COUNTY, WEST VIRGINIA COWEN B&O POND General Notice Town of Cowen (Owner) is requesting Bids for the construction of the following Project: COWEN B&O POND T70-11473 Bids for the construction of the Project will be received at the Town of Cowen located at 91 Erbacon Road, Cowen, WV 26206, until Thursday, February 19, 2026, at 2:00 p.m. local time. At that time the Bids received will be publicly opened and read. The Project includes the following Work: Erosion and sediment control, gravel parking, concrete walkway, boardwalk, kayak launch, miscellaneous items and other Work indicated in the Contract Documents. The Work will be substantially completed by May 15, 2026, and ready for final payment by May 29, 2026. Liquidated damages shall be $250.00 per day. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website. Envelope No. 1 must have the following information presented on the front: Name and address of Bidder Bid on Contract – Cowen B&O Pond Received by the Town of Cowen Envelope No. 2 labeled “Bid Proposal” shall also be placed inside of Envelope #1. Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR – 1 of these contract documents. If such documents are found to be in order, Envelope No. 2 “Bid Proposal”, will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 “Bid Proposal” will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder. A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. Bids shall be accompanied by a certified check or bid bond payable to Town of Cowen in an amount equal to five percent (5%) of the base bid. Drug Free Workplace – West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed drug-free workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of Article 1D, Chapter 21 of the West Virginia code. Failure to submit the signed drug-free workplace affidavit in the first envelope shall result in disqualification of such bid. All Bidders are required to have a West Virginia Contractor’s License per Section 30-42-12 of the West Virginia Code. Suspension and Debarment – Recipient shall not entertain the use of businesses that are listed on the “System for Award Management” (SAM) at www.Sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180. This Community Development Block Grant project is to be financed in part by a grant from the U.S. Department of Housing and Urban Development (HUD) and the West Virginia Department of Economic Development/West Virginia Community Advancement Division and shall be referred to as Project #T70-11473 – Cowen B&O Pond. Neither the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting Contract. Bidders on this Work will be required to comply with the President’s Executive Order No. 11246 and “HUD Section 109”, which prohibits discrimination in employment regarding race, creed, color, sex, or national origin. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The parties to this Contract agree to comply with HUD’s regulations in 24 CRF part 135, which implement Section 3. Noncompliance with HUD’s regulations in 24 CFR part 135 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts. Bidder’s attention is directed to the Section 3 “Clause” set forth in the Contract Documents. The contractor agrees to include this section 3 clause in every subcontract subject to compliance with regulations in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 135. Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprise participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code 21-5A-3. DBE Requirements – Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract. Notice of Federal Wage Requirements – Contractors are required to comply with all laws pertaining to prevailing wage rates for the State of West Virginia as issued by the Division of Labor and the federal wage rates issued in accordance with the Davis Bacon Act. The contractor will be required to pay the higher of the state or federal wage rates appropriate for each worker classification. Build America, Buy America Requirements – P.L. 117-58, Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a “Build America, Buy America (BABA)” requirement in Sections 70911 through 70917 that requires federally funded assistance recipients to use iron, steel, manufactured products, and construction materials that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works. The following waivers apply to this Contract: BABAA De Minimis, Small Grants, and Minor Components. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders. Bids received by Contractors that did not attend the Mandatory Pre-Bid Conference will be returned unopened to the Bidders. The Town of Cowen reserves the right to reject any and all bids. Pre-bid Conference A non-mandatory pre-bid conference for the Project will be held on Thursday, February 5, 2026, at 12:00 p.m. at Town of Cowen 91 Erbacon Road, Cowen, WV 26206. Attendance at the pre-bid conference is encouraged but not required. Instructions to Bidders.
