NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 10, 2023, executed by Borrower, Diane E Riggleman, to Carl D. Andrews, Esq., the Trustee of record in the office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 699, at Page 668. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1138 Don McCauley Road, Romney, WV 26757. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 20, 2025, of record in the Clerk’s Office in Book 735, Page 394. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on the following date:

THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF HAMPSHIRE, STATE OF WEST VIRGINIA, AND IS DESCRIBED AS FOLLOWS: All that certain tract or parcel of real estate situate in Springfield District of Hampshire County, West Virginia, lying along the East Side of Route 28/1, Buffalo Hollow Road, about 1/2 Mile North of Route 28/14 and being a portion of the same real estate which was conveyed unto Tony Farrello and Mary E. Farrello, husband and wife, by Deed of Walter L. Engle, single, by Deed dated the 13th day of November, 1957, of record in the Clerk`s Office of the County Commission of Hampshire County, West Virginia in Deed Book No. 138 at page 349. The said Mary E. Farrello died intestate in April, 1984, leaving as her sole and only heir at law, her husband, Tony Farrello, thereby vesting in him fee simple title in said real estate, which parcel of real estate herein conveyed was recently surveyed by Frank A Whitacre, Licensed Land Surveyor and according to said survey and plat the parcel of real estate herein conveyed contains 54.090 acres, more or less, and is more particularly described according to metes and bounds as follows: Description of Survey No. 85-063-01 Being a survey of a tract of land in Springfield District of Hampshire County, West Virginia, lying along the East side of Route 28/1, Buffalo Hollow Road, about ½ Mile North of Route 28/14, and more particularly described as follows: Beginning at a 5/8” Re-Bar, corner to Willard Halcolm, and Howard Cannon, and in the Farella line, thence running a new line through the Farella line, thence running a new line through the Farella land, S 47 28 02 W 2180.35` to a 5/8” Re-Bar set in the McCauley line, thence with the McCauley land, N 44 58 28 W 1120.00` to the center of Route 28/1, thence with the road, N 50 23 13 E 321.95’, N 49 18 04 E 483.11`, N 44 55 05 E 161.00`, N 49 27 45 E 232.97`, N 52 13 27 E 219.23, N 56 38 04 E 137.13`, N 50 44 14 E 372.80`, N 48 16 26 E 168.00`, N 46 20 50 E 121.88` to the corner of Willard Malcolm, thence with Malcolm, S 43 19 16 E 1025.00` to the beginning, containing 54.090 acres, more or less as surveyed by Frank A Whitacre and as shown on the attached plat. INCLUDED in the above legal description but expressly EXCLUDED from this conveyance are those tracts of land in Deed Book 548, Page 425, Deed Book 397, Page 253, Deed Book 364, Page 388, Deed Book 361, Page 248, Deed Book 353, Page 43. Being the same property conveyed to Jesse A. Riggleman and Diane E. Riggleman, husband and wife, as joint tenants with rights of survivorship, by deed from Tony Farrello, widower, dated 10-30-1987, recorded 10-30-1987, in Book: 296 Page: 444, in the office of the Clerk of the County Commission of Hampshire, County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
