NOTICE OF SALE by Mineral County Schools—Wiley Ford Primary
Please take notice that The Board of Education of the County of Mineral (“The Board of Education”) has determined that the below-described real estate is no longer needed for school purposes and that beginning at ten o’clock a.m. on the 16th day of February, 2026, at Mineral County Schools Board of Education Office located at 36 Baker Place, Keyser, Mineral County, West Virginia, The Board of Education will proceed to sell WITHOUT WARRANTY, at public auction, and subject to all requirements, terms and conditions set forth in this Notice of Sale and in Chapter 18, Article 5, Section 7 of the Code of West Virginia of 1931, as amended, all of its right, title and interest in and to a certain tract of land containing 1.34 acres, more or less, and being a part of that certain real estate commonly known as the Wiley Ford Primary School property, together with all of its right, title and interest in and to any and all improvements located thereon, and the appurtenances thereunto belonging, which 1.34 acre tract is more particularly described as follows:
BEGINNING at a 5/8” rebar found in the limits of Foxall Street, corner to Gulbronson, Lot 90 of Valley View Development, Deed Book 398, Page 609, original corner of tract of which this is part; thence with limit of Foxall Street and with original boundary of tract of which this is part,
N 11°49’08” W, 58.00’ to a point within a utility pole in the limits of Wiley Ford School Road, corner to “Reserved” lot of this division; thence, with new division line of “Reserved” lot and with limits of Wiley Ford School Road, N 11° 48’46” W, 30.48’ to a point; thence, N 16°00’52” W, 32.18’ to a point; thence,N 38°16’40” W, 26.19’ to a mag spike set; thence leaving Wiley Ford School Road, N 44°28’40” E, 65.84’ to a 5/8” X 30” rebar set; thence, N 10°57’30” E, 129.48’ to a 5/8” X 30” rebar set; thence, N 49°31’42” E, 50.68’ to a 5/8” X 30” rebar set; thence S 83°48’19” E, 134.83’ to a 5/8” X 30” rebar set; thence, S 09°35’47” W, 330.02’ to a 5/8” X 30” rebar set in boundary of Unger, Lot 91 of Valley View Development, Deed Book 387, Page 401, in original boundary of tract of which this is part; thence, with boundary of Lot 91 and with original boundary of tract of which this is part, S 87°58’25” W, passing a 1” pipe found online at 45.19’, at or near corner to said Lot 90, in all 145.19’ to the point of BEGINNING, containing 1.34 acres, more or less, as shown as “Plat of Division for Mineral County Board of Education” dated May 13, 2025, revised January 6, 2026, as prepared by Rummel, Klepper, & Kahl, LLP, Kerry Shultz, PS No. 1850 (“Plat”); and being a part of the same property conveyed to The Board of Education by the following: (1) that certain Deed dated July 27, 1950, from Benjamin G. Foxall and Effie Foxall, his wife, of record in the office of the Clerk of the County Commission of Mineral County, West Virginia (“Clerk’s Office”), in Deed Book 95, at page 195, and (2) that certain Deed dated April 20, 1951, by H. G. Shores, Attorney in Fact for Grace Bell, (nee Mikesell) and William G. Bell, her husband, et al., of record in the Clerk’s Office in Deed Book 97, at page 294;
EXCEPTED and RESERVING unto The Board of Education, its guests, invitees, successors and/or assigns, the following 20’ wide access easement and right of way for vehicular and pedestrian ingress and egress (“Access Easement”), together with the right, but not the obligation, of The Board of Education to maintain, repair, and improve the Access Easement, which Access Easement is more particularly described as follows: BEGINNING at a 5/8 x 30” rebar set at a northwesterly corner of the 1.34 acre parcel “TO BE CONVEYED” and northerly limits of “20’ ACCESS EASEMENT RESERVED”, said point being N 44°28’40” E, 65.84’; thence, N 10°57’30” E, 129.48’ from a mag spike set in the northerly limits of WV County Route 28/15 (Wiley Ford School Road) at the southwesterly corner of said parcel; thence, with the northerly limits of said easement and lines of said 1.34 acre parcel, N 49°31’42” E, 50.68’ to a 5/8 x 30” rebar set; thence, S 83°48’19” E, 134.83’ to a 5/8 x 30” rebar set at the northeasterly corner of said 1.34 acre parcel; thence, with part of the easterly line of said 1.34 acre parcel, S 09°35’47” W, 20.04’ to a point in the southerly limits of “20’ ACCESS EASEMENT RESERVED”; thence, with said limits and lines running 20’ parallel to the northerly lines of said 1.34 acre parcel, N 83°48’19” W, 125.01’ to a point; thence, S 49°31’42” W, 67.13’ to a point in a westerly line of said 1.34 acre parcel; thence, with part of said line, N 10°57’30” E, 32.08’ to the beginning, designated as “20’ ACCESS EASEMENT RESERVED” as shown on the Plat. The above referenced Plat is available for inspection at the office of The Board of Education at 36 Baker Place, Keyser, Mineral County, West Virginia 26726. The aforesaid 1.34-acre tract, together with any improvements thereon, and the appurtenances thereunto belonging, are collectively referred to below as the “Subject Property.” The Subject Property is a part of the property assessed as Tax Parcel 107, Tax Map 7, Frankfort District, Mineral County, West Virginia. The Subject Property will be sold “AS IS” and “WITH ALL FAULTS” and subject to any and all validly continuing and existing rights of way, easements, reservations, exceptions, covenants, conditions, conveyances, encumbrances, liens, agreements, leases and other matters affecting title to the Subject Property.
The sale will further be made subject to all information contained in the Asbestos Hazard Emergency Response Act Asbestos Management Plan for Wiley Ford Primary School, available for inspection at the aforesaid office of The Board of Education. The sale will further be made subject to such facts as might be revealed by an accurate survey and visual inspection of the Subject Property. Additionally, the sale will be made subject to the purchaser assuming and the deed shall provide that the purchaser assumes (a) all responsibility, obligations, and liability for hazards associated with the Subject Property (whether past, present, future, known or unknown), including but not limited to, environmental conditions or hazards and those associated with or pertaining to asbestos, lead paint, and any and all liability for clean-up, removal, or other responsibility for said hazards, and (b) any validly continuing and existing covenants or obligations of The Board of Education contained in any deeds or other instruments of record in said Clerk’s office or otherwise respecting the Subject Property. Bidding on the Subject Property shall begin at the sum of Two Hundred Ten Thousand Dollars ($210,000.00). The Board of Education reserves the right to refuse any and all bids and to adjourn the sale from time to time without any other notice other than oral proclamation at the time and place of the sale or any continuance or adjournment thereof. The sale shall be to the highest responsible bidder, but all bids are conditioned upon the acceptance thereof by The Board of Education at its first regular meeting following the auction, which acceptance by The Board of Education may be withheld for any reason or no reason whatsoever. The sale shall be made upon the following additional terms: Five percent of the sales price in cash at the time of the auction and the balance in cash due simultaneously with the tender by The Board of Education of the deed.
