NOTICE OF SALE by Mineral County Schools—Frankfort Intermediate School

Please take notice that The Board of Education of the County of Mineral (“The Board of Education”) has determined that the below-described real estate is no longer needed for school purposes and that beginning at ten o’clock a.m. on the 16th day of February, 2026, at Mineral County Schools Board of Education Office located at 36 Baker Place, Keyser, Mineral County, West Virginia, The Board of Education will proceed to sell, WITHOUT WARRANTY, at public auction, and subject to all requirements, terms and conditions set forth in this Notice of Sale and in Chapter 18, Article 5, Section 7 of the Code of West Virginia of 1931, as amended, all of its right, title and interest in and to a certain tract of land containing 1.59 acres, more or less, being more particularly described as follows:

All that piece or parcel of real estate situate, lying and being adjoining the Fort Ashby School (now known as Frankfort Intermediate School) 18.8 acre tract (more or less), in Fort Ashby, Frankfort District, Mineral County, West Virginia, and described by metes and bounds as follows:

BEGINNING at a concrete marker, said point being at the beginning corner of the tract of which this is a part; thence with a part of the first line of said tract South 73° 56’ West 513.87 feet to a rebar, set, being a division corner of the Easterly side of an old road; thence by division lines and along the East side of said road South 74° 13’ East 170.39 feet to a rebar, set; thence South 60° 28’ East 108.23 feet to a rebar, set; thence leave the road North 73° 56’ East 323.77 feet to a rebar, set, in the closing line of the whole tract, being a division of this and H. V. Barnes; thence with a part of said line and Barnes North 26° 21’ West 170.0 feet to the place of BEGINNING, containing 1.59 acres, more or less, M. B. 1982; and being the same property conveyed to The Board of Education by deed dated January 4, 1983, from Betty F. Barnes, Widow, and of record in the office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed Book 232, page 148.

The aforesaid approximate 1.59-acre tract and any appurtenances thereunto belonging, are collectively referred to below as the “Subject Property.”

The Property is assessed as Tax parcel 0128.0006, Tax Map 31, Frankfort District, Mineral County, West Virginia. Please note that the Property does not have access to a public road by either abutting a public right of way or by use of an appurtenant easement, and therefore the Subject Property is LANDLOCKED.  There are no expressed or implied rights of way or easements of any kind whatsoever being granted or given across any adjacent or adjoining property currently or previously owned by The Board of Education or any other party.

The Subject Property will be sold “AS IS” and “WITH ALL FAULTS” and subject to any and all validly continuing and existing rights of way, easements, reservations, exceptions, covenants, conditions, conveyances, encumbrances, liens, agreements, leases and other matters affecting title to the Subject Property. The sale will further be made subject to such facts as might be revealed by an accurate survey and visual inspection of the Subject Property.

Additionally, the sale will be made subject to the purchaser assuming and the deed shall provide that the purchaser assumes (a) all responsibility, obligations, and liability for hazards associated with the Subject Property (whether past, present, future, known or unknown), including but not limited to, environmental conditions or hazards and those associated with or pertaining to asbestos, lead paint, and any and all liability for clean-up, removal, or other responsibility for said hazards, and (b) any validly continuing and existing covenants or obligations of The Board of Education contained in any deeds or other instruments of record in said Clerk’s office or otherwise respecting the Subject Property.

Bidding on the Subject Property shall begin at the sum of Five Thousand Dollars ($5,000.00). The Board of Education reserves the right to refuse any and all bids and to adjourn the sale from time to time without any other notice other than oral proclamation at the time and place of the sale or any continuance or adjournment thereof. The sale shall be to the highest responsible bidder, but all bids are conditioned upon the acceptance thereof by The Board of Education at its first regular meeting following the auction, which acceptance by The Board of Education may be withheld for any reason or no reason whatsoever. The sale shall be made upon the following additional terms: Five percent of the sales price in cash at the time of the auction and the balance in cash due simultaneously with the tender by The Board of Education of the deed.

The Board of Education of the County of Mineral, West Virginia reserves the right to reject any or all bids and to waive any informalities in bidding.
