NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given
pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated January 14, 2021, executed by the Borrower, Dana Marie Hornbeck, to L. Richard Dorsey, II, the Trustee, of record in the Office of the Clerk of the County Commission of Tyler County, West Virginia, in Book 84, at Page 53. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 8315 Energy Hwy., Friendly, WV 26146. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated December 17, 2025, of record in the Clerk’s Office in Book 386, at Page 180. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Tyler County, in Middlebourne, West Virginia, on the
following date:
February 19, 2026, at 12:57 p.m.
All that certain lot, parcel, or tract of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the southeasterly side of State Route 2, south of the Town of Friendly, Union
District, Tyler County, West Virginia and bounded and described as follows:
BEGINNING at an iron pipe in the line of the Hays Heirs and the approximate northwesterly edge of the former public road, being the southeasterly corner of Lot 5 of the partition of the lands of J.C. Parker Heirs, the plat of which partition is recorded in the Office of the Clerk of the County Commission of Tyler County, West Virginia in Deed Book 75, at page 91 is incorporated herein by reference; thence with such edge of such former public road, South 60 25′ (old call 53 1/2) West 193.50 feet to an iron pipe thence North 41 00′ West 162.87 feet to an iron pipe; thence parallel to the right of way line of said State Route 2, North 52 00′ E 190 feet to an iron pipe in said line of lands of the Hays Heirs; thence with such line South 41 00′ East 191.29 feet more or less, to the place of beginning;
Being the same property conveyed unto William C.
Crane and Sharon S. Crane by Phillip R. Stanley and
Nancy J. Stanley, by Deed dated November 17, 1970,
of record in the Office of the Clerk of the County
Commission of Tyler County, West Virginia in Deed
Book 187, at page 292.
SUBJECT TO and TOGETHER WITH that certain right of way for any and all types and forms of pedestrian,
automotive, or vehicular use, bounded and described in that certain Deed dated November 17, 1970, from Phillip R. Stanley and Nancy J. Stanley, to William C. Crane and Sharon S. Crane, of record in the Office of the Clerk of the County Commission of Tyler County, West
Virginia in Deed Book 187, at page 292, and more fully described as follows:
Beginning at said iron pipe in the line of Hays Heirs; the northeasterly corner of the land herein- above
conveyed; thence, with the line of said Heirs and the northeasterly line of Lot No. 5 of the J.C. Parker Heirs Partition, N. 41 00′ W. 192.29 feet to the southeasterly edge of said W.Va. State Route 2; thence with such edge of said W. Va. Route 2, South 52 00′ W. 20 feet to an iron pipe; thence parallel to the first line hereof and 20 feet southeasterly therefrom, S. 41 00′ E. 191.29 feet to an iron pipe in the northwesterly line of the land herein conveyed to the grantee; thence with such line of the grantee’s land, N. 52 00′ East 20 feet, more or less, to the beginning;
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens,
reservations, encumbrances, restrictions,
rights-of-ways, easements, covenants, conveyances
and conditions of record in the Clerk’s office or affecting
the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole
discretion of the Trustee.
5)The Trustee shall be under no duty to cause any
existing tenant or person occupying the property to
vacate said property, and any personal property and/or
belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED
OF ACCORDINGLY.
6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
