TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 31, 2016, and duly recorded in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Deed of Trust Book 336, at Page 284, Mary E. Ash did convey unto Drew Patton, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Roane County Courthouse, in Spencer, West Virginia, on March 6, 2026, at 3:40 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Spencer District, Roane County, West Virginia, and more particularly described as follows: All those two certain lots, tracts or parcels of land situate in Spencer District, Roane County, West Virginia, and more particularly bounded and described as follows: FIRST TRACT: BEGINNING at a stake in a 6-foot alley and running thence S. 31 degrees 30′ W. 130 feet to a Black Oak at the edge of State Route No. 14; thence N. 39 degrees 15′ E. 125 feet to a stake thence N. 42 W. 39 feet to the place of beginning, containing 3,840 square feet, more or less. This conveyance is made and accepted subject to the right of prior owners in the chain of title hereto to use, repair, and maintain a certain private roadway passing through the above-mentioned lot of land from State Route No. 14 to the residence property it serves. SECOND TRACT: BEGINNING at a White Oak in the edge of State Route No. 14, which is also known as the Parkersburg Road, and which White Oak is a corner of the Ed Parrish lot; thence with two lines of said Parrish lot, N. 39 degrees 35′ E. 125 feet to a stake; thence N. 42 W. 39 feet to a stake in the edge of a 6-foot alley; thence N. 28 degrees 10′ E. 28 feet to another stake in said alley; thence S. 47 degrees 45′ E. 130 feet to a stake; thence S. 62 degrees 5′ E. 62 feet to a stake in the W.B. Rhodes’ line; thence with the W.B. Rhodes’ line, S. 37 degrees 45′ W. 155 feet to a stake at the State Route No. 14; thence with the edge of State Route No. 14, N. 65 degrees 45′ W. 34 feet to another stake in the edge of said State Route No. 14; thence N. 51 W. 120 feet to the place of beginning, containing .6 of an acre, more or less. It is further understood and agreed between the parties hereto that this deed is made and accepted subject to all valid easements and rights of way through, over and across said land, and is specifically made and accepted subject to the following easements: That certain easement granted by the said H.F. Young and Kathleen Young to the Monongahela West Penn Public Service Company, dated August 10, 1938, and of record in the Clerk’s Office in Deed Book No. 128, at page 428. The rights of the public or any adjoining land owners in and to a certain 6-foot alley way and a certain road way as are fully set forth and described in the deed from Marcellus Hardman to E. S. Harpold and Rachel Harpold dated December 1, 1909, and of record in said Clerk’s Office in Deed Book No. 53, at page 368. There is also reserved for predecessors in title, their heirs and assigns, the right to use at any and all times a certain right of way having a width up to thirty feet and extending from the northerly line of State Route No. 14; thence in a westerly direction, which right of way is more fully described and set forth in the deed from Henry F. Young and Kathleen Young to Edward B. Parrish and Mildred D. Parrish, and is further described and set forth on a certain map or plat made by L.F. Dye dated December 18, 1951, which map or plat has heretofore been filed for record in said Clerk’s Office. It is further understood and agreed between the parties hereto that this conveyance is made and accepted subject to the rights of the West Virginia Water Service Company in a certain small lot situate at the southeastern corner of the lot hereby conveyed which is now being used by said company in connection with the water system of said company. This conveyance is made subject to all outstanding interests in and to the oil, gas and other minerals within and underlying said tracts of land, and is further made subject to all valid easements and rights of way of record or apparent from an inspectionof the premises. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 184 Parkersburg Road, Spencer, WV 25276. AND BEING the same real estate which was conveyed to Mary E. Ash, by Deed dated October 31, 2016, from Orland B. Niday, and recorded in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Deed Book 544, at Page 164. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
