TO: RESPONDENTS, BESSEMER CEMENT COMPANY, UNKNOWN PERSONS/OWNERS, AND BOBBY EGGLETON, SHERIFF OF PUTNAM COUNTY, WEST VIRGINIA Notice is hereby given to Bessemer Cement Company, Unknown Persons/ Owners, and Bobby Eggleton, Sheriff of Putnam County, West Virginia (hereinafter sometimes referred to as "the aforementioned respondents"), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Putnam County, West Virginia, and is known as Civil Action No. CC-40-2025-C-203, and styled Appalachian Power Company vs. Bessemer Cement Company, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate near the City of Nitro, and being in Poca District, Putnam County, West Virginia, identified as Tax Map 235, Parcel 119, and recorded in the office of the Clerk of the County Commission of Putnam County, West Virginia, in Deed Book No. 300, at page 542, and being more specifically bounded and described as follows: B4.949 AC PLANT RD 42 ST Containing 5.001 acres located on the southerly side of 42nd Street, near the City of Nitro, Poca District, Putnam County, West Virginia, more particularly bonded and described as follows: BEGINNING at an iron pin (set) in the southerly line of 42nd Street(also known as Plant Road and Pickens Road), said point also being a common corner to the tract of land presently owned by American Viscose Company and further being located 20 feet in a southerly direction from the centerline of the existing concrete pavement of said 42nd Street, and running thence from said beginning point leaving said common corner to American Viscose Company with the southerly right-of-way line of 42nd Street (Plant Road or Pickens Road), S. 66 05 E., 198.13 feet to an iron pin (set) 20 feet from the centerline of said 42nd Street, said point also located at the point of curve; thence running with a curved line to the left with two (2) chords thereof, S. 68 30 E., a chord distance of 52.22 feet to an iron pin (set); thence running N. 85 11 E., a chord distance of 79.13 feet to an iron pin (set) at the southeasterly corner of the parcel of land hereby described, said point also being a common corner to the tract of land now or formerly owned by The New York Central Railroad Company; thence leaving said southerly line of 42nd Street and running with the southeasterly line of said parcel hereby described and with a chain link fence for most of the way, S. 23 38 W., passing the corner of said fence at 44.46 feet and continuing on in the same straight line in all a distance of 733.75 feet to a 2 inch pipe fence post at the southwesterly corner of the parcel of land hereby described; thence continuing with said chain link fence, N. 66 20 W., passing a 2 inch pipe fence post at the offset in said fence line at 258.61 feet and continuing on in the same straight line in all a distance of 270.00 feet to a punch hole cut on westerly rail of the railroad track running into parcel of land hereby described, said point being located at the most westerly corner of the parcel of land hereby described; thence running with the common division line between said parcel and the parcel of land owned by American Viscose Company and with said fence line, N. 9 53 E., passing the corner of said fence at 25.72 feet and continuing on in the same straight line in all a distance of 206.30 feet to a 2 inch pipe fence post at fence angle; thence running N. 23 01 E., passing the end of said fence at 390.58 feet and continuing on in the same straight line in all a distance of 494.85 feet to the place of beginning, containing, Five Acres and One-thousand of another acre, (5.001 Acres), more or less. The aforementioned respondents are hereby notified the said Petition for Condemnation/Right of Entry has previously been served and notice published and may be obtained from the Putnam County Circuit Clerk's office at 12093 Winfield Road, Winfield, West Virginia, 25213, for the purposes of appearing and defending.
