Ford, Jr., Nitro Fire Department, United States Environmental Protection Agency, Unknown Persons/Owners, and Bobby Eggleton, Sheriff of Putnam County, West Virginia (hereinafter sometimes referred to as "the aforementioned respondents"), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Putnam County, West Virginia, and is known as Civil Action No. CC-40-2025-C-202, and styled Appalachian Power Company vs. Dana Container, Inc.. et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Pocatalico District, Putnam County, West Virginia, identified as Tax Map 235, Parcel 91, and recorded in the office of the Clerk of the County Commission of Putnam County, West Virginia, in Deed Book No. 301, at page 191, and being more specifically bounded and described as follows: 4.920 AC & 2.957 AC NR NITRO Situated in the District of Pocatalico, Putnam County, West Virginia. The said property can be more particularly described as follows: PARCEL NO. l Beginning at an iron pin (set) in the southeasterly line of Viscose Road, said point being the beginning comer as described in that certain deed from B. F. Gravely and Sons Manufacturing Company to Coastal Tank Lines, Inc., dated May 31st, 1955 and recorded in the office of the Clerk of the Putnam County Commission in Deed Book 117, page 395, said beginning point also being a common comer to the parcel ofland containing 3.996 acres now or formerly owned by Chemical Formulators, and running thence from said beginning point leaving said common comer to said parcel now or formerly owned by Chemical Formulators with the southeasterly line of Viscose Road N. 42 32' E., 54.83 feet to an iron pin (set) at the most westerly comer of the parcel ofland containing 0.928 acre hereby described in that certain deed from Coastal Tank Lines, Inc. to C. S. T., Inc., dated February 28th, 1983 and recorded in said Clerk's office in Deed Book 270, page 263; thence leaving said southeasterly line of Viscose Road and running with five (5) common lines between the parcel of land hereby described and said C. S. T., Inc. S. 47 28' E., 29.15 feet to an old iron pin; thence running S. 70 37' E., 32.44 feet to an old iron pin; thence running S. 76 08' E., 34.06 feet to an old iron pin; thence running N. 80 .35' E., 60.65 feet to an old iron pin; thence running N. 40 43' E., 307.23 feet to an iron pin in the center line of a 50 Foot Roadway which runs along the southerly boundary line of property formerly owned by American Viscose Corporation, said point also being located at the most easterly comer of said 0.928 acre parcel of C. S. T., Inc.; thence leaving said common comer to C. S. T., Inc. and running with the centerline of said 50 Foot Roadway and the northerly line of said tract of Coastal Tank Lines, Inc., S. 76 13' E., 323.49 feet to a point in the westerly line of another 50 Foot Roadway, said point being located at the most easterly comer of the parcel of land hereby described; thence running with the westerly line of said last mentioned 50 Foot Roadway, S. 13 50' W., 565.16 feet to a point at the common comer to said parcel hereby described and parcel of land containing 2.957 acres presently owned by Coastal Tank Lines, Inc. heretofore described in that certain deed from Chemical Formulators, Inc., to Coastal Tank Lines, Inc., dated November 17th, 1965 and recorded in said Clerk's office in Deed Book 158, page 676; thence leaving the westerly line of said 50 Foot roadway and running with the "AGREED LINE" between Coastal Tank Lines, Inc. and Chemical Formulators, Inc. as shown upon a map entitled, "MAP SHOWING TRACTS OF LAND NEAR THE CITY OF NITRO IN POCATALICO DISTRICT, PUTNAM CO., W. VA. OWNED BY COASTAL TANK LINES, CHEMICAL FORMULATORS & ROBERTS CHEMICALS, INC.", dated August 1, 1963 and revised October 29, 1965, N. 55 48' W., running with the common division line between said parcel hereby described and the 2.957 acre parcel of Coastal for 330.63 feet and continuing on in the same straight line in all a distance of 620.31 feet to a point; thence continuing on in the same straight line, N. 55 48' W., 58.37 feet to the place of beginning, containing 4.920 Acres, more or less. The aforementioned respondents are hereby notified the said Petition for Condemnation/Right of Entry has previously been served and notice published and may be obtained from the Putnam County Circuit Clerk's office at 12093 Winfield Road, Winfield, West Virginia, 25213, for the purposes of appearing and defending. The Petition for Condemnation/ Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on March 26, 2026, at 1:00 p.m., in the Circuit Court of Putnam County, West Virginia, located at 12093 Winfield Road, Winfield, West Virginia, 25213, before the Honorable Phillip Stowers. You may appear for hearing as stated above and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
