REQUEST FOR PROPOSALS (RFP) CONSTRUCTION MANAGER AT RISK (CMAR) PREQUALIFIED FIRMS ONLY The Putnam County Board of Education ("Board"), located in Winfield, Putnam County, West Virginia, hereby solicits proposals from prequalified firms to provide Construction Manager at Risk (CMAR) services for the construction of a new middle school facility in Hurricane, West Virginia. This procurement is conducted pursuant to West Virginia Code 5-22B-1. PROCUREMENT METHOD AND STATUTORY AUTHORITY The Board is soliciting competitive sealed proposals from qualified firms to serve as Construction Manager at Risk (CMAR) for the Hurricane Middle School Project. The selected CMAR will provide preconstruction services during the design phase and construction phase services during the construction of the Project, including the development of a Guaranteed Maximum Price (GMP) for the Project. Selection of the CMAR will be based upon qualifications, technical merit, and price proposals evaluated according to the criteria set forth in this Request for Proposals and the requirements of West Virginia Code 5-22B. DESCRIPTION OF CONSTRUCTION PROJECT The proposed project consists of the construction of an approximately 150,000 square foot middle school facility to serve approximately 850 students in grades 6-8. The project will be located on approximately 25 acres adjacent to Hurricane High School in Hurricane, Putnam County, West Virginia. The new middle school facility will include: A two-story classroom building Full-size gymnasium and auxiliary gymnasium 1,200-seat auditorium STEAM/Media area Kitchen and cafeteria Administrative and s tudent support spaces The site will accommodate: Staff and visitor parking Separate bus loop and parent pick-up loop Event parking Outdoor learning areas Practice field Approximately 80 or more service and professional employees will work in the new school. The anticipated completion date for the Project is August 2028. Pursuant to West Virginia Code 5-22B-8(c)(6), the estimated construction cost of the Project is anticipated to be between Fifty-Eight Million Dollars ($58,000,000) and Sixty Million Dollars ($60,000,000). PROPOSED TERMS AND CONDITIONS OF THE CMAR CONTRACT Pursuant to West Virginia Code 5-22B-8(c)(2), this Request for Proposals identifies the proposed terms and conditions of the contract to be entered into between the Putnam County Board of Education ("Board") and the Construction Manager at Risk ("CMAR") selected through this procurement. The contract between the Board and the CMAR will be based upon and incorporate the following contract forms and required documents, which together shall constitute the contractual framework governing the Project: AIA Document A133-2019 – Standard Form of Agreement Between Owner and Construction Manager as Constructor AIA Document A201-2017 – General Conditions of the Contract for Construction AIA Document A101-2017 – Standard Form of Agreement Between Owner and Contractor SBA Form 401 WV96 LEA Addendum West Virginia Purchasing Affidavit WV-72 Drug Free Workplace Form WV-72 Drug Free Workplace Affidavit Contractor Certificate of Insurance Contractor Proposal submitted in response to this Request for Proposals The selected CMAR shall execute and comply with these contract documents and all applicable state procurement requirements, bonding requirements, insurance requirements, and statutory obligations applicable to public construction projects in the State of West Virginia. PRECONSTRUCTION SERVICES During the design phase of the Project, the CMAR shall provide preconstruction services including, but not limited to: Constructability reviews Cost estimating and budget development Value engineering recommendations Scheduling and phasing analysis Identification of long-lead procurement items Coordination with the architect/engineer and the Board Development of a proposed Guaranteed Maximum Price (GMP) The CMAR shall work collaboratively with the architect/engineer and the Board to ensure the Project design remains within the established budget and schedule. At the appropriate stage of design completion, the CMAR shall submit a proposed Guaranteed Maximum Price (GMP) for review and approval by the Board. SCOPE OF SERVICES The selected CMAR shall provide comprehensive construction phase services, including but not limited to: Subcontractor procurement and management Project supervision and field management Quality control Safety management Construction scheduling and coordination Project cost control Compliance with contract documents and applicable laws Project closeout and final documentation BOND AND INSURANCE REQUIREMENTS Bond Requirements: The Construction Manager at Risk (CMAR) shall furnish Performance and Payment Bonds in accordance with West Virginia Code and the requirements of the West Virginia School Building Authority for public school construction projects. The bonds shall be issued using AIA Document A312-2010, Performance Bond and Payment Bond. The amount of the Performance Bond and Payment Bond shall each be one hundred percent (100%) of the Guaranteed Maximum Price (GMP) of the Project. The surety providing such bonds shall be authorized to transact surety business in the State of West Virginia. The CMAR shall require subcontractors to provide payment and performance bonds where appropriate for the protection of the Project. AIA Contract Forms and Related Documents: The Contract for the Project will incorporate standard AIA documents typically used for CMAR procurements, including but not limited to the following: AIA Document A401-2017 – Standard Form of Agreement Between Contractor and Subcontractor AIA Document A312-2010 – Performance Bond and Payment Bond AIA Document G701-2017 – Change Order Exhibit B – Insurance and Bonds Insurance Requirements: The CMAR shall procure and maintain insurance coverage consistent with commercial construction projects of similar size and complexity and consistent with the requirements typically applied to projects funded by the West Virginia School Building Authority. The CMAR shall maintain the following minimum coverages: Commercial General Liability Insurance Automobile Liability Insurance Workers' Compensation and Employers' Liability Umbrella or Excess Liability Builder's Risk Insurance GUARANTEED MAXIMUM PRICE AND SUBCONTRACT PROCUREMENT The CMAR shall propose a Guaranteed Maximum Price (GMP) for construction of the Project at a level of design completion determined by the Board. The GMP shall include: Cost of the Work General Conditions CMAR Fee Other components necessary to complete the Project PROPOSAL FORMAT A. Technical Proposal The Technical Proposal shall include: Project approach and management plan Proposed project schedule and work sequencing Past performance on similar K-12 projects Qualifications of key personnel assigned to the Project Safety program and safety record Any other qualifications consistent with the nature, scope, and needs of the Project B. Price Proposal The Price Proposal shall include: Preconstruction services fees Construction phase fees General conditions costs Proposed approach to development of the Guaranteed Maximum Price (GMP) Evidence of bonding capacity CRITERIA FOR THE EVALUATION OF PROPOSALS The Putnam County Board of Education will evaluate proposals in accordance with West Virginia Code 5-22B. Evaluation will be based on factors including: Qualifications and experience Past performance on similar projects Project approach and management plan Key personnel Safety record Proposed fees and price proposal Total Possible Points: 100 DEADLINE Proposals must be received by the Putnam County Board of Education no later than April 20, 2026 at 4:00 p.m. Proposals must be delivered to: Superintendent John Hudson Putnam County Board of Education 77 Courthouse Drive Winfield, WV 25213 Late submissions will not be considered.
