This is Notice to Respondents, Jeremy Slamick, Heirs of Martha Lee Binder (Smith), and Unknown John Does, 1-9, and any other interested parties in the above-styled matter, that a Petition for Condemnation and Motion for Immediate Entry were filed in the Office of the Clerk of the Circuit Court of Monongalia County, West Virginia, by The City of Morgantown, against Jeremy Slamick, Heirs of Martha Lee Binder (Smith), and Unknown John Does 1-9, in March 2026. Petitioner seeks to condemn a portion of Respondent Jeremy Slamick, Heirs of Martha Lee Binder (Smith), Unknown John Does 1-9’s property identified as 657 Pennsylvania Avenue, Morgantown, West Virginia, 26501, Block 12 ½, Lot 4, Tax Map 30, Parcel 48. Take notice that the Petitioner’s Motion for Immediate Entry is scheduled for hearing on the 17th day of April, 2026, at 11:00 a.m. or as soon thereafter as counsel may be heard before the Honorable Circuit Judge Michael Simms, Monongalia County Justice Center, Suite 32, 75 High Street, Morgantown, WV 26505. The Notice Respondents may appear at the aforesaid time and place to protect their interests otherwise judgment by default may be rendered against them at any time thereafter. Copies of the Petition and Motion may be obtained from the Circuit Clerk of Monongalia County, West Virginia, 75 High Street, Morgantown, WV 26505.
