ORDER FOR PUBLICATION
The object of the above-entitled action is for violations of the City of Beckley Municipal Code of Ordinances. The said property is in violation of the following provisions of the International Property Maintenance Code: § 108.1.5.47, § 302.8, § 308.1 & § 505.1; as well as §8-204 and §15-23(s) of the City of Beckley Municipal Code. The Respondents, his/her/its heirs, successors, an/or assigns, are the recorded owners of the subject property. The subject property is identified on tax maps of Raleigh County in the City of Beckley District, on Map 13, as Parcel 00590000, further described as Lot 2 Sec 2 Central Add to City of Beckley. The property has an address of 208 7th Street, Beckley, West Virgina. Chuck Simon, also known as Rudolph Simon, acquired the subject property described as Lot No. 6, of Section No. 2 of the Central Addition to the City of Beckly, with an address of 208 7th Street, Beckley, West Virginia by Deed, dated October 27, 2021, from Danny Wright and Merriman Wright, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5075, at page 7771. Rudolph Simon died on or about February 5, 2024, a resident of Raleigh County, and by his Last Will and Testament in Book 5082, at page 5443, devised his property at 208 7th Street Beckley to his granddaughter, Nichole Simon. Christine S. Wright reserved herself a life estate in Deed from Christine S. Wright to Merriman Wright Jr., et al, dated January 9, 1985, of record in Book 693, at page 126.
It appearing by Affidavit filed in this action that the location of the Respondents and/or heirs are unknown, or that there may be Respondent(s) unknown and Respondent(s) who are nonresidents of the State for whom no agent or appointed or statutory agent or attorney in fact is found in the State upon whom service may be had to Petitioner. It is ORDERED that Respondent (s), known and unknown, which may claim any interest in the above-mentioned property, appear before the Municipal Court of the City of Beckley, and Judge Matthew Fragile. It is hereby notified that on the 14th day of May, 2026, at 1:30 p.m., or as soon thereafter as counsel can be heard, the City of Beckley, will appear before the Municipal Court of the City of Beckley, Raleigh County, West Virginia, Judge Fragile, at 169 Industrial Drive, Beckley, West Virginia, for the further proceeding with respect to said violations of the City of Beckley Municipal Code of Ordinances. Failure to appear could result in a judgement entered against the Respondent(s), including, but not limited to: fines; order authorizing the Petitioner to enter the subject property to clean up rubbish and/or garbage or other refuse on the property, tow all inoperable vehicles, demolish the unsafe structure on the said property, and any other matters necessary to bring the property up to compliance with City of Beckley Municipal Code, of which all costs of said actions by the Petitioner will result in liens filed against the subject property; as well as any and all other relief that may be justified by the Court.
