NOTICE OF SUCCESSOR TRUSTEE’S SALE NOTICE OF SUCCESSOR TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Successor Trustee by that Deed of Trust, executed by borrower(s), Christopher Todd Wallace and Denvia Anne Wallace, dated June 25, 2008, and recorded on July 15, 2008 in the office of the Clerk of the County Commission of Mingo County, West Virginia (the “Clerk’s Office”), in Book 411, at Page 292. Matthew L. Ward (“Successor Trustees”) was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEES dated March 13, 2026, and recorded in the Clerk’s Office on March 26, 2026, in Book 509, at Page 435; as well as that Security Interest of Community Trust Bank, Inc. in a 2001 Clayton, doublewide in the name of Christopher Todd Wallace and Denvia Anne Wallace, West Virginia Department of Transportation, Division of Motor Vehicles, Identification Nos. CH000091KYA and CH000091KYB (the “Mobile Home”) granted by the Wallace’s and which the Mobile Home is located on the real property which is the subject of the foregoing Trust Deed. The borrower(s) have defaulted under the Note and Deed of Trust and the Successor Trustee has been instructed, by Community Trust Bank, Inc., to foreclose under the Deed of Trust. Accordingly, the Successor Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mingo County, in Williamson, West Virginia, on: WEDNESDAY, MAY 6, 2026 AT 10:30 A.M. The property is described as that certain parcel of land, together with all improvements thereon and the appurtenances thereto, and being more particularly described as follows: The following described real estate situate on Rockhouse Fork of Pigeon Creek, near Ragland, Lee District, Mingo County, West Virginia, being more particularly bounded and described as follows, to-wit: BEGINNING at a Georgia Pacification Station No. 15806, a steel pin, situate on the southern bank of Rockhouse Fork; Thence, running up Rockhouse Fork with the original calls of the 0.77 acre parcel as surveyed by Georgia Pacific Corporation on March 2, 1981 for George and Anna Curry the following three calls, S. 59 degrees 44′ E – for a distance of 125.57 feet to a steel pin noted as Station No. 15807; Thence, S. 45 degrees 10′ E – for a distance of 99.99 feet to a steel pin noted as Station No. 15808; Thence, S. 41 degrees 12′ E. – for a distance of 51.12 feet to a 5/8-inch rebar & cap stamped B.M.S. Inc. 837-SU set in concrete; Thence, crossing through the said 0.77 acre parcel a new call of S. 49 13′ W – for a distance of 76.44 feet to a 5/8 inch rebar set in a concrete at the northernmost limits of a 40 foot access road and on the original line of the said 0.77 acre parcel; Thence, running down and with the said 40 foot access road and the calls of the said 0.77 acre parcel N. 36 48′ W. – for a distance of 49.97 feet to a steel pin noted as Station No. 15812; Thence N. 43 38′ W. – for a distance of 179.63 feet to a steel pin noted as Station No. 15813; Thence, leaving the said road limits N. 01 24′ W. – for a distance of 52.09 feet to the point of beginning. Being the same property conveyed to Christopher Wallace and Denvia Wallace, his wife, by Roger Bruce Wallace and Tonya Faye Wallace, his wife, by deed dated June 3, 2008, of record in the Office of the Clerk of the County Commission of Mingo County, West Virginia, in Deed Book 420, at Page 404. Common Address: US Highway 65/5, Boy Scout Road, Delbarton, West Virginia 25670; And Mobile Home: 2001 Clayton Doublewide manufactured home in the name of Christopher Todd Wallace and Denvia Anne Wallace, West Virginia Department of Transportation, Division of Motor Vehicles, Identification Nos. CH00009.1KYA and CH000091KYB. TERMS OF SALE: 1. The property and the Mobile Home will be conveyed in an “AS IS, WHERE IS” physical condition by Deed containing no warranty, express or implied; 2. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever; 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code; 4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale; 5. The Successor Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof; 6. The Successor Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY; 7. The total purchase price is payable to the Successor Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent. 8. The Successor Trustee and Agent reserves the right to offer the above-described Real Estate and Mobile Home separately and to contingently accept the highest bids thereon. Thereafter, bids will be taken on the Real Estate and Mobile Home as a single unit and the highest bid contingently accepted. After the offering of said property as hereinabove provided, the bid or bids submitted will be accepted in a manner that will result in the highest total price for all such property. In the event that the bid accepted is the bid for the property as a single unit then the successful bidder shall designate which portion of such bid is attributable to the Real Estate and which is attributable to the Mobile Home for purposes of transfer taxes. The Successor Trustee and Agent further reserve the right to only sell either the Real Estate or Mobile Home if a bid for one or the other is in an amount sufficient to satisfy the expenses of the sale and the indebtedness secured thereby.
