The action involves the ownership of oil and natural gas interests underlying approximately 508.5 acres of property situated in Ohio County, West Virginia (“Subject Property”).
The Subject Property was conveyed to Joseph B. Ford, Joseph P. Connelly,
Otho W. Heiskell and John Handlan, by four separate Deeds all dated July 17, 1859, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 44, at pages 130, 131, 132 and 134.
It appearing by Affidavits of Bryan J. Karickhoff and Robin Phelphs filed in this action that Plaintiffs have exercised due diligence in attempting to asccertain the current residences and names of the unknown heirs, devisees, successors and assigns of Joseph P. Connelly, Otho W. Heiskell and John Handlan, including the four (4) unlocatable heirs, devisees, successors and assigns, to-wit: Sherry Donahoe Mills,, Katherine Hillmam Mills Miller, Dennis Redmond, Lisa Weber, and desire to achieve service of process upon them by publication pursuant to West Virginia Rule of Civil Procedure 4(e)(1)(C) and (E).
Accordingly, it is hereby ORDERED pursuant to W.Va.R.Civ.P.4(e)(1)(C) and (E). that Related Defendants, Sherry Donnahoe Mills. Katherine Hillman Mills Miller, Dennis Redmond, Lisa Weber, as well as any other unknown heirs of Joseph P. Connelly, Otho W. Heiskell and John Handlan, appear and serve upon Plaintiffs’ consel, Howard M. Persinger, lll, of the law firm Persinger & Persinger, L.C., 237 Capitol Street, Charleston, West Virginia 25301, an answer or other defense to the Amended Complaint filed in this action by May 20, 2026, which is not fewer than thirty days after the date of the first publication of this Notice.
A copy of the Amended Complaint can be obtained from the Ohio County Circuit Clerk’s Office in the Ohio County Courthouse located at 1500 Chapline Street, Wheeling, West Virginia 26003.
