NOTICE OF TRUSTEE'S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Stewart Roger McKalip and Kat S. McKalip, executed and delivered to P. Michael Pleska and F. Thomas Graff, Jr., Trustees, bearing date May 8, 2003, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3014 at page 927; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated March 24, 2026, of record in the aforesaid Clerk's Office in Trust Deed Book 4797 at page 909; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on the 6th day of May, 2026, at 11:00 o'clock a.m., of all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the easterly side of Chester Road, in the City of South Charleston, Kanawha County, West Virginia, being the northerly 35 feet of Lot No. 212, and the southerly 35 feet of Lot No. 213, of Block M, as said lots are laid out and shown on the map of Edgewood, made by Melvin Cuptill, C.E., dated 1906, and of record in the office of the Clerk of the County Court of Kanawha County, West Virginia, Photostatic Map Book 2, page 7, said parcel hereby conveyed being more particularly bounded and described as follows: BEGINNING at an iron pin in the easterly line of said Chester Road, which said pin is located S. 11 00' W. 15 feet from the common front corner of Lots Nos. 213 and 214, Block "M" Edgewood; thence running through said Lot No. 213 and 214, Block "M" Edgewood; thence running through said Lot No. 213, S 79 00' E. 130 feet to an iron pin in the rear line of said Lot No. 213 thence with the rear lines of Lots Nos. 213 and 212, Block "M" Edgewood, S 11 00' W. 70 feet to an iron pin in the rear lot line of Lot No. 212; thence running through said Lot No. 212, N. 79 00' W. 130 feet to an iron pin in the easterly line of Chester Road, N. 11 00' E. 70 feet to the place of beginning. And being the same property conveyed unto Stewart Rogers McKalip and Kate S. McKalip, by Harvey J. Simmons, Jr. and Martha C. Simmons, his wife, by deed dated March 9, 1968, and recorded in the aforesaid Clerk's Office in Deed Book 1517, at page 305. The referenced property will be conveyed with covenants of special warranty subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
