ADVERTISEMENT TO BID Sealed bids for the Weston Sanitary Board (Weston) Sludge Dewatering Project – Phase 2 will be received by the Weston Sanitary Board, 102 West 2nd Street, Weston, West Virginia 26452 until 2:00 PM, L.P.T., on May 28, 2026 for furnishing labor and materials and performing all work set forth in the Advertisement to Bid, Information for Bidders, Bid Form, General Conditions, Supplementary Conditions, Davis and Bacon (Federal) Prevailing Wage Rates, Federal Contract Provisions, Specification Special Conditions, Technical Specifications and Plans (Drawings) prepared by Potesta & Associates, Inc., and any and all addenda issued prior to receipt of Bids. Immediately following the scheduled closing time for the reception of bids, all proposals which have been submitted in accordance with the conditions of this project will be publicly opened and read aloud. The Work to be bid upon is generally described as follows: Construction work at the wastewater treatment plant of a complete sewage sludge dewatering system, including: Installation of sludge transfer pumps. Construction of sludge drying beds. Construction of a polymer injection system. Site development and excavation. All necessary piping and fittings to make a complete system as described on the Plans and in the Specifications. Construction time limit for the Contract is 365 consecutive calendar days to substantial completion for Base Bid work, and 400 days for final completion. Liquidated damages are $750.00 per each day that expires after the time limit for substantial completion until the work is substantially complete. There are three (3) additive alternates being considered for the project. Additive Alternate No. 1 – Third Sludge Drying Bed Additive Alternate No. 2 – Second Sludge Transfer Pump Additive Alternate No. 3 – Greenhouse Garage Door Electric Operators Drawings, Specifications and Contract Documents may be examined at the following places: The Contractor's Association of WV 2114 Kanawha Boulevard, East Charleston, West Virginia 25311 Weston Sanitary Board 102 West 2nd Street Weston, West Virginia 26452 Contract documents may be obtained at Potesta & Associates, Inc. (POTESTA), 7012 MacCorkle Avenue, SE, Charleston, West Virginia 25304, telephone number (304) 342-1400, upon payment of $50 for electronic copy or $150 for each set of hard copy documents. If paying by check, make check payable to Potesta & Associates, Inc. If paying electronically, call POTESTA at the above number and ask for Charlene Armstead. Information for Bidders and Bid Form will be furnished upon request. The two envelope system will be used for bidding this project. Envelope No. 1 will contain the required bidder information as outlined in the Contract Documents. Envelope No. 2 will contain the Bid Form only and be separate from Envelope No. 1. The two envelopes shall be held together with clips or rubber bands. Both sealed envelopes containing the Bidder Information and Bid Form must have the following information clearly printed or typed on the front lower left hand corner of each envelope. ENVELOPE NO. 1: "ENVELOPE NO. 1 Bid on Weston Sanitary Board Sludge Dewatering Project – Phase 2 to be submitted by 2:00 PM, L.P.T., on May 28, 2026. Bidder Information: Submitted by: (insert name and address of bidder)." ENVELOPE NO. 2: "ENVELOPE NO. 2 Bid on Weston Sanitary Board Sludge Dewatering Project – Phase 2 to be submitted by 2:00 PM, L.P.T., on May 28, 2026. Bid Form: Submitted by: (insert name and address of bidder)." Envelope No. 1 will be opened first and the Bid Bond, Power of Attorney, Certificate of Compliance and other pertinent and required documents will be checked to make sure that all documents are in order. If the documents are found to be in order, Envelope No. 2 containing the Bid Form will then be opened and publicly read aloud. If the documents from Envelope No. 1 are not in order, Envelope No. 2 containing the Bid Form will not be opened and the bid will be considered non-responsive and will be returned to the Bidder. A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. Bids shall be accompanied by a certified check or bid bond payable to the Weston Sanitary Board in an amount not less than five percent (5%) of the base bid. A mandatory Pre-Bid Conference will be held at the Weston Sanitary Board Office at 102 West 2nd Street, Weston, West Virginia 26452 on May 13, 2026 at 1:30 P.M. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders. Weston Sanitary Board reserves the right to reject any and/or all bids. Prospective Bidders are advised that the contract awarded under this bid is to be funded in whole or in part by funds from the Clean Water State Revolving Fund. Bidders are required to have West Virginia Contractor's license per Section 30-42-12 of the West Virginia code. Bidders will be required to comply with the West Virginia Alcohol and Drug Free Workplace Act. Bidders must comply with the President's Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, Section 3 Segregated Facilities, Section 109 and the Contract Work Hours Standard Act. Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed or national origin. Federal Law prohibits discrimination on the grounds of race, color, national origin, religion, age, handicap and sex in this project. Minority firms are particularly encouraged to participate. Bidders must comply with the requirements and policies as outlined in State Revolving Loan Fund. Bidders must comply with Disadvantaged Business Enterprise utilization or EPA Federal Regulation 40 CFR Part 33 – Procurement Under Assistance Agreements stated that loan recipients and Contractors must comply with the six affirmative steps as outlined on 33.240 and any other requirements of the state. NOTICE OF FEDERAL WAGE REQUIREMENTS Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The Contractor will be required to pay the federal wage rates appropriate for each worker classification. DBE REQUIREMENTS Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The Bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a property signed bid. The Bidder agrees to make "good faith efforts" to subcontract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term "subcontractor" includes all construction, modification, and service work contracted for by the Bidder in the execution of the work under this contract. NONDISCRIMINATION IN EMPLOYMENT "Bidders on this work will be required to comply with the President's Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications." AMERICAN IRON AND STEEL Bidder will be required to comply with the "American Iron and Steel (AIS)" requirements of Section 436 of P.L. 113-76, Consolidated Appropriations Act, 2014 (Act) that requires Clean Water State Revolving Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.
