NOTICE OF TRUSTEE'S SALE

The undersigned Substitute Trustee, by virtue of the authority vested in her by that certain Deed of Trust executed by and between DAVID H. SHUMATE and SANDRA SHUMATE, (Borrowers), and JONI COOPER RUNDLE (First Trustee), and FIRST COMMUNITY BANK, NA., ("Lender”), dated the 23rd day of August, 2004, and of record in the Office of the Clerk of the Wyoming County Commission in Wyoming County, West Virginia, in Trust Deed Book 228, at Page 957. Whereas, said Lender having nominated and appointed ANNA R. ZIEGLER, ROBERT A. GARDNER, DAVID L. ZIEGLER, and the law firm of Ziegler & Ziegler, L.C., any one of whom may act, ("Substitute Trustees"), by Substitution of Trustee dated September 17, 2025, and of record in the aforesaid Clerk's Office in Book 309 at page 487. Said Deed of Trust being presently in default, the said Substitute Trustee having been requested by the beneficiary thereof so to do, NOW, THEREFORE, we, ANNA R. ZIEGLER, ROBERT A. GARDNER, DAVID L. ZIEGLER, and the law firm of Ziegler & Ziegler, L.C., Substitute Trustees as aforesaid, will proceed to sell the hereafter described real estate at public auction on the 13th day of May, 2026, at the hour of 11:00 a.m., to the highest bidder for cash in hand, 10% down the day of the auction, remainder due within 30 days of the sale, at the front door of the Courthouse of Wyoming County, West Virginia, which real estate is located in the Slab Fork District, Wyoming County, West Virginia, and is more particularly described as follows:

All those certain lots or parcels of real estate, together with all the improvements thereon and all of the rights, privileges, easements, and appurtenances thereunto belonging, situate in Slab Fork District, Wyoming County, West Virginia, and more particularly described as follows, to-wit:

PARCEL NO. 1:

Beginning at a white oak and maple at the most northerly corner of the Townsite of Bridge Branch; thence running S 34 31 E for 380.49 feet to a white oak corner; thence S 20-29 W for 423.0 feet to a stake; thence leaving the outside boundary of Bridge Brance and cutting across the northern end of the property N 40 16 E for 690.0 feet to a stake on the northern boundary of said Townsite; thence running with the northern boundary N 52 16 W for 403.0 feet to the place of beginning, containing 2.45 acres, more or less, and being the same property conveyed to David Shumate by Delpha Shumate by deed dated January 9, 1986, and of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 350 at Page 441.

PARCEL NO. 2:

Beginning at a white oak corner on a flat, leaving the oak down the hill 150 feet to a stone corner, then around the hill side 175 feet to a black gum corner leaving the gum down the side of straight line 175 feet, mor or less, to a stone; thence running up the hill with Estie Lafferty's line 186 feet to a planted stone; thence running up the hill 69 feet to a planted stone on Estie Lafferty's line, thence running around the hill with Estie Lafferty's line, 70 feet to a planted stone on Jay Wellman's line, thence running up the hill with Jay Wellman's line 73 feet, more or less, to a planted stone on a ridge; thence running up the ridge with the old original line 437 feet, more or less to the place of beginning, containing one and one half (1 ½), more or less, together with all the rights, easements, and appurtenances thereunto appertaining, and being the same property conveyed to David Shumate by Delpha Shumate by Deed dated January 9, 1986, and of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 350 at Page 441.

AND

TRACT NO. 2:

Beginning at a stone corner made for Gracie Lafferty, thence down the hill a straight line 121 feet, more or less, to a planted stone in the field, thence running around the hill a straight line 121 feet more or less to a planted stone, thence running up the hill a straight line 95 feet, more or less, to a chestnut stump stone corner calls for at same stump in Gracie Laffertys deed, thence running with Gracie's line up the hill side 175 feet more or less, to a black gum, a corner made for Gracie Lafferty, leaving the gum corner running around the hillside with Gracie's line 175 feet, more or less, to a stone corner made for Gracie Lafferty, the place of beginning, one acre and one half, more or less.

TRACT NO. 3:

Beginning at a chestnut stump corner calls for in No. 1 tract on the ridge, a corner between Gracie Lafferty and Etsie Lafferty, thence running around the hill 39 feet to a white oak, thence running down the hill 56 feet to a red oak, then around the hill 78 feet to a planted stone on Rice Lafferty's line, thence up the hill 71 feet to place of beginning corner, containing one half acre, more or less.

TRACT NO. 4:

Beginning on a red oak corner to No. 2 Tract, running a straight line around the hill 30 feet to a red oak, leaving the oak running across the point a straight line 89 feet to a chestnut stump, then up the hill a straight line 139 feet to a chestnut stump called for in No. 2 tract, thence down the hill a straight line 39 feet to a white oak corner down the hill a straight line 56 feet to place of beginning, containing one half acre, more or less.

The said Tracts 2, 3, and 4 being the same property conveyed unto David Shumate from Delpha Shumate, a/k/a Delphia Shumate, by deed dated September 21, 1999, and of record in the Office of the Clerk of the Wyoming County Commission in Deed Book 400 at Page 630.

AND

Map 114, Parcel 16:

1.87 Acres (S), situate in Milam Fork, and being the same property conveyed to Perry Lafferty by James M. Lafferty and Ellie Lafferty, his wife, by deed dated December 9, 1946 and recorded in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, on April 30, 1947, in Deed Book 120 at Page 212.

Perry Lafferty died intestate July 19, 1953, leaving to survive him as his only heirs at law his widow, Janie Lafferty, and two grandchildren, Lewis Denoff and Daisy Hall. The mother of those two grandchildren was the only child of Perry Lafferty and Janie Lafferty, Janie Denoff, who died on July 8,1949. Janie Lafferty died June 12, 1992. And being the same property conveyed to Daisy Hall by Lewis Denoff and Elsie Denoff, his wife, and Daisy Hall and Ralph Hall, her husband, by Deed dated October 5, 1995, recorded in the aforesaid Clerk's office in Deed Book 384 at Page 843. Further being the same property conveyed to David Shumate by Daisy Hall by Deed dated November 28, 2001, recorded in the aforesaid Clerk's office in Deed Book 409 at Page 001.

THIS SALE IS MADE subject to such easements, rights-of-ways, restrictive covenants, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to said real estate.

SAID SALE SHALL BE SUBJECT TO THE FOLLOWING CONDITIONS:

1) 10% of the successful bid shall be paid by the successful bidder unto the Substitute Trustee(s) the day of sale, by cash or certified funds. The balance of said bid shall be due via certified funds unto the Substitute Trustee(s) within 30 days of the sale.

2) Subject to any and all mineral rights and reservations, stipulations, restrictions, reservations, easements, conditions and covenants contained in all former conveyances of the subject property or appearing of record in the aforesaid Clerk's Office except any pertaining to race, color or creed.

3) Subject to all real estate taxes against said property and any taxes which constitute a lien upon the said property but which are not yet due and payable.

4) The subject property will be sold in AS IS condition. The trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

5) The property will be conveyed by the undersigned Trustee(s) to the purchaser without warranty of any kind, expressed or implied.

6) The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof.
