TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 29, 2014, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed of Trust Book 2893, at Page 184, John O’Donnell did convey unto Robert C. Brower, Jr. and Daniel V. Lawson, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at 400 West Stephen Street, in Martinsburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Mill Creek District, Berkeley County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of real estate together with the improvements thereon and appurtenances thereto belonging, situate in Mill Creek District, Berkeley County, West Virginia, and more particularly described as follows:

Being the southwest portion of the residue of Lot No. 6, as same is designated on a plat of “Paynes Ford Development” made by Gamma Associates, Engineers, Dated May 30, 1974, and recorded in the office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 278, at Page 646 and 647, being more particularly described as follows:

Beginning at a post, being a common corner to Lot No. 3, 4 and the lands of William Thomas; thence with Lot No. 4 N. 22-19 W. 431.4 feet to a common corner of a 1.5165 acre sold by the Rakes to Theurer by deed dated the 29th day of November, 1977, and recorded in the aforesaid Clerk’s Office; thence with the land of Matilda Theurer N. 70-28 E. 200 feet to a new corner; thence by a new division line the residue of Lot No. 6 owned by the Grantors S. 20-16-14 E. 351.54 feet to a point in the lands of William Thomas; thence with the lands of William Thomas S. 47-05 W. 200 feet to the point of beginning, containing 1.7339 acres more or less.

Subject to and together with that right of way as more particularly described as follows, to wit:

Beginning a (1) a found ½” capped rebar corner to Gary R. Spaulding, DB 373, P 576, (part of northern portion of Lot -6 of Payne’s Ford Development plat, DB 278, P 646 and 647) also southwest corner to a 30′ wide right of way through the said Spaulding lot said point being in the line of Ray Gilkerson, Lot-4 (DB 292, P 390), thence leaving Gilkerson and with said Spaulding N. 70° 28′ E. 30.03′ to (2) a point being the southwest corner of 30′ R/W through Spaulding lot, thence leaving Spaulding and with new lines through the land of Virginia A. Christine DB 383, P 157, the southwest portion of aforesaid Lot-6) the following courses: S 22° 19′ E. 54.60′ to (3) a point, thence S. 89° 01′ E 78.53 to (4) a point, thence S. 80° 22′ E. 109.46′ to (5) a point in the line of Virginia A. Christine, DB 376, P 457, (the southeasterly portion of aforesaid Lot-6), thence with Christine DB 376, P 458, S 20° 16′ 14″ E. 34.61′ to (6) a set ¾” iron pipe corner to the line of the former, thence leaving the southeasterly portion of Lot-6, and again new lines through Christine’s land (DB 368, P 157) the following courses: N 80° 22′ W124.81′ to (7) a set ¾” iron pipe, thence N. 89° 01′ W 63.03′ to (8) a set ¾” iron pipe, thence S. 67° 41′ W 30.00′ to (9) a set ¾” iron pipe in the line of Gilkerson thence with the latter N 22° 19′ W 88.66′ to (1) the point of beginning, as shown on a plat by Girolamo G. Marino, Registered Surveyor, WV LLS #388, recorded in Deed book 396, at Page 489.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 201 Spaulding Way, Bunker Hill, WV 25413.

AND BEING the same real estate which was conveyed to John O’Donnell by Deed dated August 29, 2014, from Dorothy J. Stabler, Trustee of the Dorothy J. Stabler Trust, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 1080, at Page 458.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
