TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 17, 2018, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed of Trust Book 3310, at Page 595, Mark W. Henderson and Heather C. Morris did convey unto Pill & Pill, PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at 400 West Stephen Street, in Martinsburg, West Virginia, on

May 19, 2026, at 10:18 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Falling Waters District, Berkeley County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of real estate together with the improvements thereon and appurtenances thereto belonging, situate in Falling Waters District, Berkeley County, West Virginia, and more particularly described as follows:

All of Lot 1 containing 2.00 acres, more or less, as set forth on a survey made by Frederick Sibert & Associates, Inc., dated November 2, 2010 and recorded in the Office of the County Clerk of Berkeley County, West Virginia in Plat Cabinet 15, at Slide 70.

SUBJECT TO AND TOGETHER WITH an access easement for the benefit of Lots 1, 2 and Residue for ingress, egress and utilities which is set forth on surveys by Frederick Seibert & Associates, Inc., dated March 31, 2011, and attached as Exhibit A and Exhibit B to a deed recorded in the aforesaid Clerk’s Office in Deed Book 981, at page 533, which shall be maintained by those making beneficial use thereof.

AND BEING the same parcel of real estate conveyed to Mark W. Henderson and Heather C. Morris, by deed dated October 17, 2018, from James E. Fazenbaker and Gladys E. Fazenbaker, and recorded in the office of the Clerk of the County Commission of Berkeley County, West Virginia, immediately preceding this instrument.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2510 Broad Lane, Falling Waters, WV 25419.

AND BEING the same real estate which was conveyed to Mark W. Henderson and Heather C. Morris, by Deed dated October 17, 2018, from James E. Fazenbaker and Gladys E. Fazenbaker, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 1227, at Page 699.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
