TRUSTEE'S SALE
OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 23, 2021, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Document No. 202100008459, in Book No. 1277, at Page 833, Larry A Willett, Jr and Jennifer Willett did convey unto Larry F. Mazza & Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by CITIZENS BANK OF N.A. F/K/A RBS CITIZENS BANK N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Grant District, Marion County, West Virginia, and more particularly described as follows:

All of the following described parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in a Subdivision named "Junglewood", in Grant District, Marion County, West Virginia, as shown on a map or plat entitled "Revised Plat of Junglewood Sections 1 & 2, Grant District, Marion County, West Virginia", prepared by K & R Engineering Company, dated April 1979, recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 822, Page 315, that is to say:
All of Lot No. Thirty-Five (35) of Junglewood Subdivision, Section 2, as shown on a map or plat of said Lot No. 35 which is attached to that Deed of record in Deed Book No. 829, at Page 35, and being bounded and described as follows:
Beginning at an iron pin in the westerly line of a thirty (30) foot street called "Elephant Walk", a corner to Lot No. 36 of said Section 2, Junglewood, and running thence with line of said Lot No. 36, N. 37° 10' W. 132.82 feet to a stake, another corner to said Lot No. 36 and in line of Lot No. 8 of Section 1 of said Junglewood; thence with said Lot No. 8, N. 55° 00' E. 9.12 feet to an iron pin in line of said Lot No. 8; thence with said Lot No. 8 and continuing with line of Lot No. 9 of said Section 1, Junglewood, N. 65° 00' E. 72.54 feet to an iron pin in line of said Lot No. 9, a corner to Lot No. 34 of said Section 2, Junglewood; thence with line of said Lot No. 34, S. 37° 10' E. 126.04 feet to an iron pin in said westerly line of said thirty (30) foot street called "Elephant Walk"; and thence with said westerly boundary of said street, two lines, S. 65° 00' W. 42.00 feet to an iron pin and S. 52° 50' W. 39.00 feet to the place of beginning.
Together with the non-exclusive right and easement to use all of the streets, alleys, and ways as set out in said Junglewood Subdivision, for any and all proper purposes of travel.
This conveyance is made together with all buildings and improvements, rights, roads, ways, easements, privileges, appurtenances, and advantages thereunto belonging or in any way appertaining.
The real estate is subject to all exceptions, reservations, easements, covenants, conditions, agreements, land use regulations, rights-of-way, restrictions, servitudes, municipal ordinances, leases, prior out conveyances, prior conveyances of minerals and rights to extract the same, mineral severances and limitations of use as have been imposed upon such property, and those shown on all recorded plats of survey, of record affecting the real estate, to the extent the same are now in effect.
Being the same lot or parcel of real estate conveyed unto Letitia A. Welling, by Drew Hale and Shawna Hale, by that General Warranty Deed dated October 11, 2017 and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 1216, at Page 964.
And further being the same parcel of real estate conveyed unto Larry A. Willett, Jr. and Jennifer A. Willett, by Letitia A. Welling, to be recorded simultaneously with the recording of this Deed of Trust.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 35 Elephant Walk, Fairmont, WV 26554.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
