NOTICE IS HEREBY GIVEN that an action has been instituted in the Circuit Court of Berkeley County, West Virginia, bearing Civil Action No. CC2026-C-119, upon the Third-Party Defendant, Janet Everhart.
1. Plaintiff, Jasmine Lynn Caton (“Plaintiff”) requested this Court to recognize Plaintiff’s undivided one-half interest in real estate, declare that partition in kind of the real estate may not be fairly, equitably or conveniently made, interests of the parties to be promoted by an allotment of the property and no parties interests will be prejudiced by the allotment, and appoint a commissioner.
2. Kenneth Tsuneishi (“Defendant”) by counsel, and for its Third-Party Complaint for Quiet Title and Interpleader has brought forth this third-party complaint for the purpose declaring the 2022 deed’s “Executrix” reference is a scrivener’s error; (b) Third-Party Defendant was duly appointed and acting as Administratrix at time of conveyance; (c) the deed conveyed the estate’s entire interest intended to pass to Defendant; and (d) Defendant is the fee simple owner against claims through the Plaintiff, Third-Party Defendant or the Estate; and order any such other relief as deemed proper by this Court.

Arbaugh, Esq., and Joseph E. Meadows, Esq., attorneys for Defendant, located at 300 Summers Street, Truist Square, Suite 1000, Charleston, WV 25301. Defendants must respond to the Third-Party Complaint and make yourself known to the Plaintiff on or before June 1, 2026, or action may be taken by the Court in accordance with the law.
