NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated September 7, 2016, executed by Borrower(s), Nathan A Billips, to Anna R. Ziegler, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1323, at Page 74. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 7211 Coal Heritage Rd, Bramwell, WV 24715. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 7, 2025, of record in the Clerk's Office in Book 1492, Page 211. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

26th day of May, 2026
at 12:40 p.m.

BEING that certain tract or parcel of land lying on the waters of Bluestone River in Rock District, Mercer County, and situate on the south side of Bramwell, West Virginia, said tract or parcel of land being more particularly bounded and described as follows: BEGINNING at a 5/8 inch iron rod set in the western right-of-way line of U. S. Route Number 52, said point situate N. 42° 11' E. 139.07 feet from the northeast corner of a two story dwelling situate on said 2.33 acres being conveyed; thence with the western right-of-way line of said Route Number 52 and at a distance of 40 feet from the centerline of the asphalt pavement S. 19° 14' W. 248.91 feet to a point; thence continuing with said right-of-way N. 70 46' W. 30.00 feet to a point; thence continuing with said right-of-way S. 19° 14' W. 69.23 feet, said line traversing with an old wire fence line, to a 1-1/2 inch iron pipe set and referenced 8.6 feet southwest of two Ash Trees, marked as pointers; thence leaving said right-of-way line and through the Goodman property the following: S. 85° 05' W. 297.20 feet to a 3/4 inch iron pipe set, said point referenced as situate N. 12° 51' E. 27.5 feet from a 14 inch Poplar Tree, marked as a witness and also situate N. 04° 55' W. 25.00 feet from a one inch iron pipe set on the east side of a fence post; thence N. 04° 22' E. 283.87 feet to a nail and cap set in the base of a double Poplar Tree, marked as a corner; thence N. 85° 23' E. 408.97 feet to the point of BEGINNING, and containing 2.33 acres. AND BEING the same property conveyed unto Bobby R. Casey and Louise M. Casey, wife and husband, from Jack A. Goodman, Marion G. Goodman, William F. Goodman, Ellen Goodman Hart and Daniel Hart by deed dated July 27, 1982 of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 614 at Page 236. AND FURTHER BEING the same property Bobby R. Casey conveyed his one- half undivided interest unto Louise M. Casey by deed dated October 25, 1983 0f record in the aforesaid Clerk's Office in Deed Book 626 at Page 365. THERE IS HOWEVER EXCEPTED AND RESERVED from the above mentioned property an outsale consisting of 0.11 acre conveyed from the said Louise M. Casey unto John A. Horton of record in the aforesaid Clerk's Office in Deed Book 705 at Page 695. SAID PROPERTY was conveyed unto NATHAN A. BILLIPS by deed recorded on September 7, 2016 in Deed Book 1040, Page 737.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
