Default having been made in the terms of a certain Deed of Trust dated November 12, 2008, in the original principal amount of $100,529.00 and recorded in the Clerk's Office of the Circuit Court of the County of Tazewell, Virginia on November 18, 2008, in Deed Book 1042, at page 0536, as Instrument Number 080005313, the undersigned Substitute Trustees will sell at public auction on June 09, 2026 at 12:30 PM, in front of the building housing the County of Tazewell Circuit Court, 135 Court Street, Tazewell, VA 24651, the property designated as ALL those certain lots or parcels of land situate in Tazewell County, Virginia, upon the waters of Clinch River and on Hubble Hill on the Baptist Valley side of said hill and north of the highway leading from the Town of Tazewell to Baptist Valley, and more particularly bounded and described as follows: Tract No. 1: BEGINNING at a point in said public highway, a corner to land of A. J. Higginbotham, Jr.; thence N. 48 degrees 28' E. 146.3 feet passing an east gate post to a point; thence S. 19 degrees 40' E. 180.4 feet to a fence post; thence S. 72 degrees 10' W. 114.9 feet to a point in said road on line of said Higginbotham; thence along said road by said Higginbotham, N. 19 degrees 44' W. 88.2 feet to a point; thence N. 50 degrees 45' W. 40 feet to the beginning, containing 0.42 of an acre; Tract No. 2: BEGINNING at a hub in the northern right of way line of Virginia Highway No. 645 and a common corner with parcel No. 1; thence leaving said Highway and with the lines of Parcel No. 1, N. 13 degrees 33' E. 154.00 feet to an iron pin; thence N. 55 degrees 04' E. 945.34 feet to an iron pin and a point in a line of Parcel No. 3; thence with the lines of Parcel No. 3 S. 3 degrees 45' E. 210.00 feet to an iron pin; thence S. 26 degrees 23' W. 990.00 feet plus or minus to a point in the Northern right of way line of Virginia Highway No. 645; thence with said right of way line of said Highway in a northwesterly direction 605.00 feet plus or minus to the beginning, containing 9.70 acres more or less, together with the real estate lying between said tract of land and the middle of Virginia Highway No. 645. "The party of the first part does hereby grant and convey unto John Robert Rasnick, III the right to take water from the spring on Parcel No. 1 (Parcel No. 1 found of record in the aforesaid Clerk's Office in Deed Book 368, page 337); by pipeline as now installed to a tank and to the residence property conveyed to the said Cecil B. Nord (therein called Mrs. Cecil Williams) by W. R. Bennett by deed dated January 25, 1939, and of record in said Clerk's Office in Deed Book 138, page 252, which water right was conveyed by deed dated August 12, 1939 and of record in said Clerk's Office in Deed Book 140, page 189, and by deed dated October 2, 1939 and of record in said Clerk's Office in Deed Book 140, page 532, and the said party of the first part and the party for the second part agree to use jointly the road right of way from Route No. 645 along their joint line to the respective residence property, which said rights are appurtenant to the real estate hereby conveyed." Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises. TERMS: CASH. A deposit of $10,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee's Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review upon request before the sale, outlining additional terms of sale and settlement.
