Wolfe, III Attorney at Law, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Plymouth District, Mercer County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of land as shown as Lot No. 40, Section "A" on a Map attached hereto and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, known as Microfilm Plat No. 7594, which said Map bears the legend, "MAP SHOWING A PARCEL OF LAND TO BE CONVEYED TO CHARLES W TIBBS AND JOAN S. TIBBS, HIS WIFE, BY RALPH KIBLINGER AND NELMA G. KIBLINGER, SITUATED IN PLYMOUTH DISTRICT, MERCER COUNTY, W. VA., SCALE 1"=50', DRAWN 11-8-77, R. W. McCOMAS, P.E., Reg. No. 2229," which said lot is more particularly bounded and described as follows:
BEGINNING at an iron pipe on the South side of a forty foot service road,
a common corner of Lot 39, Section "A"; thence with said road, N. 44° 20' E. 65.5 feet and N. 59° 15' E. 30.0 feet to an iron rod, a common corner of Lot 41, Section "A"; thence with line of Lot 41, S. 31° 00' E. 169.5 feet to an iron Pipe, a common corner of lots 41-30 and 29, Section "A"; thence with line of Lot 29, S. 62° 10' W. 93.2 feet to an iron rod, a common corner of Lot 29, 28 and 28, Section "A"; thence with line of Lot 39, Section "A", N. 31° 15' W. 145.0 feet to the point of BEGINNING and containing 0.35 of an acre (35/100 Ac), more or less.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 360 Damson Avenue, Princeton, WV 24739.
AND BEING the same real estate which was conveyed to Joyce Ann Morgan, by Deed dated December 31, 2018, from Joan A. Tibbs, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 1073 at Page 451.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
