IN THE CIRCUIT COURT OF HARRISON COUNTY, WEST VIRGINIA A NOTICE OF ELECTION FOR THE UNEXPIRED TERM OF CLERK OF THE CIRCUIT COURT OF HARRISON COUNTY, WEST VIRGINIA A Proclamation by the Judges of the 19th Judicial Circuit Circuit Court of Harrison County, West Virginia The Honorable Christopher J. McCarthy, Chief Judge The Honorable Joseph F. Shaffer, Jr., Judge The Honorable D. Andrew McMunn, Judge WHEREAS, due to the untimely passing of Albert F. Marano, Jr., Clerk of the Circuit Court of Harrison County, West Virginia, on April 16, 2026, and pursuant to the provisions of West Virginia Code 3-10-1, 3-10-6, and 3-5-19, the unexpired portion of his elected term of office must be filled by special election at the next general election. THEREFORE, it is hereby PROCLAIMED that such the unexpired portion of his elected term of office as Clerk of the Circuit Court of Harrison County, West Virginia will be filled by the voters of Harrison County, West Virginia in a special election to be placed on the ballot and conducted concurrently with the 2026 General Election set for Tuesday, November 3, 2026. THEREFORE, it is hereby further PROCLAIMED that nominations for this special election upon the remaining portion of Circuit Clerk Marano’s unexpired term may be made pursuant to West Virginia Code 3-5-19(b), to-wit: “a nominee of each political party may be appointed by the executive committee and certified to the proper filing officer no later than 78 days before the general election.” (Thereupon, such date is accordingly calculated to be AUGUST 17, 2026). THEREFORE, it is hereby further PROCLAIMED that additional nominations for this special election upon such remaining portion of the unexpired term may also be timely made pursuant to subsection (f) of West Virginia Code 3-10-1 which provides in pertinent part therein, “…citizens having no party organization or affiliation may nominate candidates as provided by sections twenty-three and twenty-four, article five of this chapter: ….” (i.e., 3-5-23 Certificate nominations; requirements and control; penalties (effective: June 5, 2018) and 3-5-24 Filing of nomination certificates; time; location; fees; effect of failure to timely file or pay fee (effective: June 6, 2014)). ACCORDINGLY, the Clerk of the Harrison County Commission must receive any such certification of nomination in keeping with such applicable code provisions no later than seventy-eight (78) days prior to the date of November 3, 2026, that being the general election date, to-wit: MONDAY, AUGUST 17, 2026, for any appropriately certified nomination to fill the unexpired portion of Clerk of the Circuit Court Marano’s elected term. This NOTICE OF ELECTION is made by and through the Circuit Court of Harrison County, West Virginia, and pursuant to the applicable provisions of West Virginia Code 3-10-1, 3-10-6, and 3-5-19.
