NOTICE INTENT TO REQUEST RELEASE OF FUNDS (NOI-RROF)

On or about Monday, June 8, 2026, the City of Morgantown will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended (P.L. 93-383) to undertake the following activity that is anticipated to be funded in FY 2026 through FY 2028 (Grant Nos. B-26-MC-54-0007 through B-28-MC-54-0007).
Title. The title of the Tier 1 Broad Level Review activity is CD-26-06 Healthy Homes Rehabilitation Program (CDBG) (Multi-year)
Purpose. The purpose of the Healthy Homes Rehabilitation Program is to preserve the safety, habitability, and long-term viability of income-eligible owner-occupied housing units through the replacement of deficient HVAC units, hot water tanks, and/or roofs using CDBG funds.
Locations. The site-specific locations for the Healthy Homes Rehabilitation Program will be determined as eligible activities are identified, however the service area for this activity is city-wide.
Activity Description, Costs, and Timeline. CDBG funds will be used for the replacement of HVAC, hot water tanks, and/or roofs of income eligible owner-occupied housing. The project budget for FY 2026 is $50,000.00, with an estimated allocation of $200,000 from FY 2026 through FY 2028. The program is anticipated to begin in Calendar Year 2026 and be completed in Calendar Year 2029, or until allocated funds are exhausted. The City estimates approximately 15 homes over the three-year period will be receive rehabilitation assistance, depending on the scopes of work for each participating dwelling unit and available CDBG funds allocated to this activity.
Levels of Environmental Review Citation. The level of environmental review for the Healthy Homes Rehabilitation Program is Categorically Excluded Subject to Section 58.5 under 24 CFR Part 58.35(a)(3)(i). Tier 2 Site-Specific Environmental Reviews (ERs) will be completed for those laws and authorities not addressed in the Tier 1 Broad-Level Environmental Review, which include: Flood Insurance [Flood Disaster Protection Act and National Flood Insurance Reform Act]; Contamination and Toxic Substances [24 CFR Part 58.5(i)(2)]; Floodplain Management [Executive Orders 11988 and 13690]; Historic Preservation [National Historic Preservation Act]; and, Noise Abatement and Control [Noise Control Act of 1972 as amended by the Quiet Communities Act].
Mitigation Measures, Conditions, and/or Permits. For each housing rehabilitation activity, requisite building and related permits and notices will be obtained; applicants receiving rehabilitation assistance whose owner-occupied dwelling units are located in a Special Flood Hazard Area (1-Percent Annual Chance Floodplain) will be required to obtain and maintain flood insurance; testing of lead-based paint, asbestos, mold, radon, and/or other potentially toxic and hazardous substances will be completed and mitigation measures implemented, as required; dwelling units proposed for rehabilitation that are located in a Federal Flood Risk Management Standard (FFRMS) floodplain will be subject to the either the Eight-Step Decision Making Process set forth in 24 CFR 55.20 or the Modified Five-Step Decision Making Process as set forth in 24 CFR 55.14(c); consultation with the West Virginia State Historic Preservation Officer (WV SHPO) will be completed as set forth under Section 106 of the National Historic Preservation Act of 1966 (NHPA); and, owners of residential dwellings to be rehabilitated will be notified if their dwelling unit is located within 15 miles of an airport, 3,000 feet of a train, and/or 1,000 feet of a major roadway that potential noise generated by airplanes, trains, and/or vehicles nearby may exceed the average acceptable noise level as determined by HUD.
The Environmental Review Record (ERR) that documents the environmental determination for this activity is on file at the City of Morgantowns City Managers Office, 430 Spruce Street, Morgantown, WV 26505, and is available for public examination and copying, upon request, during normal business days (Monday through Thursday) from 7:00 a.m. to 5:30 p.m.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments concerning this ERR to the City Managers Office either by mail to ATTN: Robyn Hess, Grant Writer, 389 Spruce Street, Morgantown, WV 26505 or by email to [email protected]. All comments received by Thursday, June 4, 2026, will be considered by the City of Morgantown prior to authorizing submittal of a request for release of funds to HUD.
ENVIRONMENTAL CERTIFICATION
The City of Morgantown certifies to HUD that Ms. Jamie Miller, in her capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and these responsibilities have been satisfied. HUDs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Morgantown to use CDBG Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Morgantowns certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Morgantown; (b) the City of Morgantown omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the City of Morgantown or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with required procedures (24 CFR Part 58, Section 58.76), and shall be submitted to the HUD Pittsburgh Field Office of Community Planning and Development (CPD) via email to [email protected]. Potential objectors should contact HUD to verify the actual last day of the objection period.
