The object of the above-entitled action is to obtain a judgment for damages for Defendants default under that certain Note, as is more particularly described in the Complaint filed herein.
It appearing by Affidavit filed in this action that the Defendant, Jarren West Harper, is a resident of Fayette County, Pennsylvania; that the Plaintiff unsuccessfully attempted to obtain service of the Summons and Complaint upon the Defendant, Jarren West Harper, two (2) times via the West Virginia Secretary of State; and that the Plaintiff has used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure to ascertain the current address or whereabouts of the Defendant, Jarren West Harper, but has not been successful in doing so.
It is therefore ORDERED that JARREN WEST HARPER, appear and serve upon Keith J. Pappas, counsel for Plaintiff, whose address is 176 Fayette Street, Morgantown, West Virginia 26505, a response or other defense to the Complaint heretofore filed in this action within thirty (30) days after the date of first publication of this notice. Otherwise, the Court may render a judgment of default against JARREN WEST HARPER at any time thereafter, thereby granting the relief requested by Plaintiff in the Complaint.
A copy of said Complaint can be obtained from the Office of the Clerk of the Monongalia County Circuit Court, Monongalia County Justice Center, 75 High Street, Suite 12, Morgantown, West Virginia 26505.
