NOTICE OF INTENT TO CONVEY PROPERTY OWNED BY THE DESTINY CHRISTIAN CENTER IN THE CIRCUIT COURT OF CABELL COUNTY, WEST VIRGINIA IN RE: The Petition of Daniel Porter, Trustee of Destiny Christian Center, and any other remaining members of the Destiny Christian Center, a dissolved religious organization, for the Courts disposition of property owned by said Church to Christ Temple Church. Hammers Notice is hereby given that in accordance with West Virginia Code 35-1-12 and 35-1-10, the above stated Petition has been filed with the Circuit Court of Cabell County, West Virginia requesting the said Court to appoint a Special Commissioner to convey property owned by the Destiny Christian Center, a dissolved religious organization, to Christ Temple Church. Said property is known as 2499 Health Creek Road, Barboursville, Cabell County, West Virginia and is described as follows: All that certain lot, piece or parcel of land situate in McComas District on the waters of the Guyandotte River near Martha, in Cabell County, West Virginia, being more particularly described as follows: BEGINNING at a 30 inch diameter double sycamore tree; thence N. 88 25' W. 312.51 feet to a Number Four Rebar (set) on the northern edge of right of way to Heath Creek Road, said Rebar is located near a stem footing for a guy-wire attached to a power pole; thence along and with said right of way S. 18 W. 258.42 feet to a Number Four Rebar (set); thence leaving said road right of way S. 70 44' E. 311.64 feet to a one inch diameter steel pipe (set); thence N. 20 44' E. 121.5 feet to a Number Four Rebar (set) at the top of a bank near a small wooden structure; thence N. 13 40' E. 232.93 feet to the BEGINNING, containing 95,522.04 square feet or 2.193 acres, more or less: the northern, northwestern portions of the above described lot is SUBJECT TO an easement for a possible future water impoundment. The limits of the easement are to be described by the high water mark of said water impoundment. An additional easement is hereby granted outside the above described parcel intended solely for the purpose of maintaining only the existing septic system. The duration of this easement shall be equal to the life of the existing septic system. EXCEPTING AND RESERVING 0.692 acres conveyed to Danny A. Porter and Deborah Porter, husband and wife, by deed dated August 29, 1979, and recorded in Deed Book 805, at page 448.
