This matter came before the Court upon Plaintiff's Motion for Order of Publication pursuant to Rule 4(e) of the West Virginia Rules of Civil Procedure. The Court, having reviewed the Motion, the Affidavit of Due Diligence, the record in this matter, and being otherwise sufficiently advised, FINDS as follows:
1.Defendant Corey Dowdin is a necessary party to this action.
2. Plaintiff has made diligent efforts to locate and personally serve Defendant Corey Dowdin.
3.Personal service upon Defendant has not been accomplished despite Plaintiff's diligent efforts.
4.Plaintiff has submitted an affidavit setting forth facts supporting constructive service pursuant to Rule 4(e) of the West Virginia Rules of Civil Procedure.
5.Constructive service by publication is appropriate under the circumstances.
Accordingly, it is hereby ORDERED that Plaintiff's Motion for Order of Publication is GRANTED.
It is further ORDERED that Plaintiff is authorized to serve Defendant Corey Dowdin by publication pursuant to Rule 4(e) of the West Virginia Rules of Civil Procedure.
It is further ORDERED that the Order of Publication / Notice attached hereto, or otherwise approved by the Clerk, shall be published in a qualified newspaper of general circulation in Corey Dowdin, County, West Virginia, once a week for two successive weeks, unless otherwise required by law or further order of this Court.
It is further ORDERED that, if Defendant's last known address is known, Plaintiff shall mail a copy of the Summons, Complaint, and Order of Publication to Defendant at said last known address and file proof of such mailing.
It is further ORDERED that Plaintiff shall file proof of publication with the Clerk upon completion of publication.
The Clerk is directed to enter this Order and transmit copies to all counsel of record and any self-represented parties.
