The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 18, 2022, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19751161, in Book No. 1659, at Page 23, Arnold Etter Kuhl, Jr and Mary Ann Kuhl did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC s/b/m Nationstar Mortgage LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 06 – Triadelphia District, Ohio County, West Virginia, and more particularly described as follows:
Land situated in the County of Ohio in the State of WV.
A parcel of land situated in Triadelphia District, Ohio County, West Virginia along Cedar Rocks Road (designated New Public Road) bounded and described as follows:
Beginning at a 5/8 inch iron rod set on the north side of said road at southwest corner of Parcel No. 2, as designated on the plat recorded in the Office of the Clerk of the County Commission of Ohio County, W. VA, in Deed Book 634, at page 494 (hereinafter referred to as ‘The Plat’), and also located S 61 05′ W 155.00 feet from a concrete monument found at the southwest corner of Lot No. 10 and the southeast corner of Lot No. 11 of Orchard Acres; thence running with the north side of said road the following two (2) lines S61 05′ W 45.00 feet to appoint; thence S59 25′ W 30.00 feet set a 5/8 inch iron rod; thence running with the lands remaining to Walter L. Hartman, et al., N 28 55′ W 423.01 feet set a 5/8 inch iron rod in the line of lands of Neil Mundie (Deed Book 618, Page 795), passing through 5/8 inch iron rods set at 89.05 feet and at 230.87 feet; thence running with same N 71 14′ E 76.18 feet set a 5/8 inch iron rod at the northwest corner of said Parcel No. 2; thence running with Parcel No. 2 S 28 55′ E 408.71 feet to the place of beginning passing through 5/8 inch iron rods found at 166.35 feet and at 355.71 feet, being Parcel No. 3 containing 0.715 acres, more or less, as surveyed by Charles V. Eller, L.L.S., November 12. 1986, and shown on ‘The Plat’ as referenced above and made part of this description.
Said described Tract is a part of Lots 12 and 13 of Orchard Acres and a Part of Tract 13 of Cedar Rocks Farm.
Bearings are oriented with Orchard Acres.
Reserved unto Walter L. Hartman and Gloria L. Hartman, his wife, et al., a certain fifteen (15) foot sewer line right of way running across the tract described hereinabove, as said right of way is designated and described in Prior Deeds of conveyance of this property.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
