SUBSTITUTE TRUSTEE’S SALE OF VALUABLE REAL ESTATE

Notice is hereby given that the undersigned Trustee, appointed by document dated May 21, 2026, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1154, at page 341, will sell at public auction to the highest bidder on:

Thursday, July 9, 2026,
at 10:00 a.m.,

at the front door of the Marshall County Courthouse, 600 7th Street, Moundsville, West Virginia, that certain property conveyed by Samuel W. Pauley for the benefit of Belmont Savings Bank, Beneficiary, by Deed of Trust dated July 11, 2022, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 1102, at page 302, and being described as follows:
The following described 1.636 acre parcel of land situate in Meade District, Marshall County, West Virginia, along Games Ridge Road, bounded and described as follows:
Beginning at a point in the center of Games Ridge Road and located the following two (2) lines from the northwest corner of Dorothy Whetzal’s 17.445 acre tract, a plat of same being recorded in Deed Book 472, at Page 740, Marshall County records: N. 50 degrees 03′ 30″ E. 124.18 feet to a point; N. 46 degrees 48′ 32″” E. 54.62 feet to said beginning point of the herein described tract; thence running to point located in the center of the road the following six (6) lines: N. 46 degrees 48′ 32″ E. 58.80 feet to a point; thence N. 45 degrees 32′ 35″ E. 269.72 feet to a point; thence N. 57 degrees 04′ 57″ E. 128.64 feet to a point; thence N. 72 degrees 40′ 44″ E. 95.90 feet to a point; thence S. 88 degrees 35′ 11″ E. 123.69 feet to a point; thence S. 73 degrees 12′ 21″ E. 61.30 feet to a point; thence leaving said road and running through lands remaining to said 17.445 acre tract the following three (3) lines: S. 59 degrees 04′ 35″ W. 285.61 feet to a 5/8 inch rod located southeast 2.65 feet from a power pole No. 32-282, also passing through a 5/8 inch iron rod at 14.45 feet; thence S. 55 degrees 18′ 54″ W. 383.56 feet to a 5/8 inch iron rod in a fence line; thence N. 44 degrees 19′ 56″ W. 81.37 feet to the place of beginning, passing through a 5/8 inch iron rod set at 66.11 feet, containing 1.636 acres, more or less, as surveyed by Charles V. Eller, County Surveyor, May 17, 1989, and shown on a plat recorded in Deed Book 546, at Page 293, Marshall County records.
Being the same property conveyed to Samuel W. Pauley by Stephen B. Whetzal, by deed dated May 11, 2022, and recorded in Marshall County Deed Book 1135, at page 374.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120 day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
